02-11-2010 VC WS-MMINUTES OF THE WORKSHOP SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA FEBRUARY 11, 2010 Present: Absent: ROLL CALL David B. Hernacki, P.E., Councilman Jimmy Knight, Village Manager Len Rubin, Village Attorney Melissa Teal, Village Clerk Edward M. Eissey, Ph.D., Councilman Mayor Norris called the meeting to order at 9:40 p.m. All members of Council were present, except Councilman Eissey, who was attending a meeting at St. Jude Hospital in Tennessee. All members of staff were present. APPLICATION FOR SPECIAL PERMIT FOR SIMILAR USES This item was removed from the agenda due to withdrawal of the application. PROSPERITY FARMS ROAD CORRIDOR STUDY (NORTH SEGMENT Village Planning Consultant Jim Fleischmann, Land Research Management, Inc. was present to review the Prosperity Farms Road Corridor Study. Mr. Fleischmann discussed implementing an overlay zoning district, such as an ROI, or residential, office, and institutional overlay, and allowing landowners with parcels that abut major roadways to petition for something other than residential zoning, usually small businesses, or small institutional uses. Mr. Fleischmann explained the advantages of this method, which would identify allowable land uses and set specific policies for the Prosperity Farms Road Corridor, as a cost effective and efficient means of expediting applications for changes in use. Mr. Knight described an overlay district by segment, which might limit non-residential use to only a business tax receipt, provide for mixed-use development in the south segment, or keep certain areas residential only, such as north of Lighthouse Drive on the east side of the corridor. Mr. Knight explained the process as follows: areas would be identified on the Village's Future Land Use map, policies defining the allowable use would be developed for each segment, and criteria would be established stipulating the maximum percentage of a house allowed for business use or determining which vacant parcels of land may be redeveloped for business use. It was noted that the current zoning code pertaining to permitted uses would need to be reviewed. Discussion ensued on establishing an overlay district for Prosperity Farms Road. Regarding the North Central Segment, Council consensus was to consider CC-Transitional zoning for the Estates parcel and proposed Oak Hollow parcel, and Rl or R-2 zoning for these properties on the west side: 10313 Prosperity Farms Road, 2520 Palm Lane, and 10179 Prosperity Farms Road. Regarding properties on the east side, Council consensus was to consider Rl or R-2 zoning from the Lubavitch center north, and between Teal Way and Pelican Way. Minutes of Village Council Workshop Session held February 11, 2010 Page 2 of 2 Discussion took place regarding relaxing the restrictions on home-based businesses within the Prosperity Farms Road corridor. A concern was expressed with allowing an increase level of office use in a residential area. Discussion took place on establishing aone-story height limit, as well as limits to the floor area ratio (FAR) for the two parcels considered for CC-Transitional zoning. Council will review and discuss the South Central Segment of the Prosperity Farms Road Corridor Study at the next Workshop Session on February 25, 2010.
