09-16-2010 VC WS-MMINUTES OF THE WORKSHOP SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA • SEPTEMBER 16, 2010 Present: William L. Manuel, Mayor Darryl C. Aubrey, Sc.D., Vice Mayor David B. Gebbia, Councilman Jimmy Knight, Village Manager Leonard Rubin, Village Attorney Melissa Teal, Village Clerk ROLL CALL Mayor Manuel called the meeting to order at 9:15 p.m. All members of Council were present. All members of staffwere present. VOLUNTARY ANNEXATION AND SMALL-SCALE COMPREHENSIVE PLAN AMENDMENT Mr. Knight reported the Village received applications for voluntary annexation of seven parcels of real property located generally north of Richard Road and west of the FEC Raikoad right-of- way, within the Village's Future Annexation Area 4. The Planning Commission held a public hearing regarding the voluntary annexation and small-scale comprehensive plan amendment on 9/14/10, and approved the applications as submitted. Village Planner Jodi Nentwick gave a presentation on the voluntary annexation application and planning consultant Jim Fleischmann, Land Research Management, Inc., reviewed the proposed small-scale comprehensive plan amendment. Discussion ensued on level of service issues including non-conforming structures, lighting and fire hydrants. Mr. Rubin noted that non-conforming structures cannot be enlarged or moved. Mr. Fleischmann related that the Village previously annexed a 1.71 acre parcel of vacant property located at the southeast corner of Old Dixie Highway and Richard Road. Mr. Fleischmann reviewed the current zoning designation and future land use designation in conjunction with the proposed small-scale comprehensive plan amendment, -which would change the future land use designation from Palm Beach County Commercial High 5 to Village of North Palm Beach Light IndustriaUBusiness, consistent with Policy 13.4.2 of the Annexation Element of the Village Comprehensive Plan. Mr. Fleischmann reported that the Planning Commission, sitting as the Local Planning Agency, unanimously recommended approval of Small-Scale Comprehensive Plan Amendment 10-2.1, which staff also recommends. Mr. Fleischmann reviewed Small-Scale Comprehensive Plan Amendment 10-2.2, which pertains to the seven parcels of land that are the subject of simultaneous annexation and land use map amendment applications. Mr. Fleischmann reported the voluntary annexation area, known as • Western Annexation II, consists of approximately 4.56 acres of land with existing land uses that include a vacant parcel, 11 residential units, and a small business complex at the northeast corner of Old Dixie Highway and Richard Road. Mr. Fleischmann reviewed the current zoning designation and future land use designation, and noted the proposed amendment would change the future land use designation to Village of North Palm Beach Light IndustriaUBusiness. Minutes of Village Council Workshop Session held September 16, 2010 Page 2 of 2 • Mr: Fleischmann reported that the Planning Commission, sitting as the Local Planning Agency, unanimously recommended approval of Small-Scale Comprehensive Plan Amendment 10-2.2, which staralso recommends. Mr. Fleischmann noted a comment received from Seacoast Utility Authority regarding assignment of an industrial land use designation for properties within the wellfield area associated with the Richard Road water treatment plant. Mr. Fleischmann advised that this concern is addressed by policies in the Village Comprehensive Plan, as well as the Palm Beach County wellfield protection ordinance. Discussion took place concerning the tentative list of proposed uses for the light industrial zoning district. Mr. Knight reported that the tentative list is based on uses allowed by Palm Beach County; however, the Village's list of proposed uses is more restrictive. Mr. Rubin advised that the list would be included as a sample conceptual list and attached as an exhibit to the annexation ordinance. It was suggested that any regulations concerning overnight parking of commercial vehicles not be too restrictive. Discussion ensued as to whether any of the proposed uses might be restricted due to proximity to the wellfield. Mr. Fleischmann explained that restrictions apply to the substances that are handled or processed, which may be prohibited or regulated, dependent upon the zone in which the business is located. The proposed land uses of a park or a farmers market were questioned regarding consistency with light industrial uses. A concern was raised regarding commercial kennels. By consensus, this item was moved forward to the September 30, 2010 Special Session agenda.
