Attorney reads title of Ordinance 2010-13, establishing and adopting an ad valorem tax millage rate for the fiscal year commencing 10/1/10 and ending 9/30/11. b. Attorney reads title of Ordinance 2010-14, adopting a budget for the fiscal year commencing 10/1/10 and ending 9/30/11. c. Motion to adopt Ordinance 2010-13 (Millage) on first reading. d. Motion to adopt Ordinance 2010-14 (Budget) on first reading. e. Staff presentation on both ad valorem tax millage rate and budget. f. ACTION PUBLIC HEARING AND MOTION – SPECIAL USE PERMIT – COD & CAPERS SEAFOOD 2. Consider a motion to approve or deny application for Special Use Permit to allow Cod & Capers Seafood to operate a retail and wholesale seafood market with a restaurant/bar at 1201 U.S. Highway 1 as a similar use to those permitted within the C-1 Neighborhood Commercial zoning district, subject to certain conditions and in accordance with Village policy. ACTION D. CONSENT AGENDA The Consent Agenda is for the purpose of expediting issues of a routine or pro-forma nature. Councilmen may remove any item from the Consent Agenda, which would automatically convey that item to the Regular Agenda for separate discussion and vote. 1. OTHER VILLAGE BUSINESS MATTERS RESOLUTION – PARTIAL REIMBURSEMENT OF ATTORNEY’S FEES AND COSTS 1. Consider a motion to adopt a proposed resolution approving partial reimbursement of attorney’s fees and costs personally expended by Patti Unruh in defending the lawsuit filed against the Village and Unruh by Marcel Agnolin in the total amount of $19,500; funds to be expended from Council Contingency account. ACTION RESOLUTION – STATE AID TO LIBRARIES GRANT FUNDING 2. Consider a motion to adopt a proposed resolution authorizing filing of an application for State Aid to Libraries Grant Funding, providing required assurances and certifications, approving a two year long- range plan and an annual plan of services, and authorizing execution of the grant agreement. ACTION RESOLUTION – NORTHLAKE BLVD. TASK FORCE INTERLOCAL AGREEMENT 3. Consider a motion to adopt a proposed resolution approving the Third Amendment to the Amended and Restated Interlocal Agreement relating to the Northlake Boulevard Task Force extending the term for an additional one year period, and authorizing execution of the agreement. ACTION RESOLUTION – REVISED UNIFIED LOCAL MITIGATION STRATEGY PLAN 4. Consider a motion to adopt a proposed resolution approving and adopting the 2009 revised Unified Local Mitigation Strategy Plan in its entirety as approved by the Federal Emergency Management Agency in accordance with the State of Florida, the Board of County Commissioners and the Palm Beach County Emergency Operation Center. ACTION RESOLUTION – PROPERTY CASUALTY INSURANCE COVERAGE 5. Consider a motion to adopt a proposed resolution accepting one of the proposals submitted in response to the RFP issued by the Village for its Property and Casualty Insurance Program and authorizing Village Administration to execute the necessary documents to secure this coverage. ACTION RESOLUTION – LEASE AGREEMENT – POLICE MOTORCYCLES 6. Consider a motion to adopt a proposed resolution approving a lease agreement with Harley Davidson of Ormond Beach, Florida for two police motorcycles for the Public Safety Department. ADJOURNMENT If a person decides to appeal any decision by the Village Council with respect to any matter considered at the Village Council meeting, he or she will need a record of the proceedings and for such purpose he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (F.S. 286.0105). In accordance with the Americans with Disabilities Act, any person who may require special accommodation to participate in the meeting should contact the Village Clerk’s Office at 841-3355 at least 72 hours prior to the meeting date. This agenda represents the tentative agenda for the scheduled meeting of the Village Council. Due to the nature of governmental duties and responsibilities, the Village Council reserves the right to make additions to, or deletions from, the items contained in this agenda.
