ORDINANCE N0. 203-69
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEAC}}, FLORIDA,
REGULATING LOITERING OR PROWLING UNDER CIRCUMSTANCES WARRANTING '
A JUSTIFIABLE AND REASONABLE ALARM OR IMMEDIATE CONCERN FOR THE
SAFETY OF PERSONS OR PROPERTY; PROVIDING A PENALTY THEREFOR.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM REAC}[,
FLORIDA:
Section 1. No person shall loiter or prowl in a place,
at a time, or itr a manner not usual for law-abiding individuals under
circumstances that warrant a justifiable and reasonable alarm or
immediate concern for the safety of persons or property in the
vicinity.
Section 2. Among the circumstances which may be con-
sidered in determining whether such alarm or immediate concern '
is warranted is the fact that the actor takes flight upon appear-
ance of a peace officer, refuses to identify himself, or manifestly
endeavors to conceal himself or any object.
Section 3. Unless flight by the actor or other circum-
stances makes it impracticable, a peace officer, shall prior to any
arrest for an offense under this Ordinance afford the actor an
opportunity to dispel any alarm or immediate concern which would
otherwise be warranted, by requesting him to identify himself and
explain his presence and conduct. No person shall be convicted
of an offense under this Ordinance if the peace officer did not
comply with the preceding sentence, or if it appears at trial that
the explanation given by the actor was true and, if believed by the ,
peace officer at the time, would have dispelled the alarm or immediate
concern.
Section 4. Any person violating the provisions of this
Ordinance shall, upon conviction thereof, be punished by a fine not
to exceed Five }[undred Dollars or by imprisonment not to exceed
sixty days, or by both such fine and imprisonment.
