Areas61~ ORDINANCE N0. 201-69 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEAC}{, FLORIDA, SETTING FORT}[ RULES AND REGULATIONS CONCERNING THE USE OF PUBLIC PARKS AND RECREATION AREAS IN THE VILLAGE OF NORTH PALM BEAC}{, FILING PERMITS POR USE, SETTING FORTH STANDARDS FOR THE ISSUANCE OF PERMITS AND PF;NALTIES FOR THE VIOLATION OF THE TERMS OF THIS ORDINANCE. BF, IT ORDAINED BY T}{E VILLAGE COUNCIL OF NORTH PALM BEAC}{, FLORIDA: Section 1. USE BY RESIDENTS AND GUESTS ONLY. The use of ~ the public parks and recreation facilities of the Village shall be i`~ ,,,N~ limited to residents and invited guests of residents of the Village. V V Section 2. RF,SPONSIBILITY FOR ENFORCEMENT OF PROVISIONS. T}xe recreation director, park attendants and police officers shall, in cormection with their duties imposed by law, diligently enforce the provisions of this ordinance. Section 3, EJF,CTMENT OF VIOLATORS. The recreation director, ' park attendants and police officers shall have the authority to eject from any park in the Village any person acting in violation of this ordinance. Section 4. CONFISCATION OF PROPERTY USED TO VIOLATE PROVISIONS. 1'he recreation director, park attendants and police officers shall have the authority to seize and confiscate any property, thing or device in any village park used in violation of this ordinance. Section 5. PERMIT REQUIRED. If a meeting, gathering or other assemblage for a common purpose, cause, activity or reason, in any park or recreation area, will involve an attendance of over ten persons and is not a part of a scheduled program or activity either sponsored or officially recognized by the Village, or participation ' or attendance in a sports event at an appropriately designated park area, the person responsible for or in charge of such meeting or gathering shall obtain a permit from the recreation director before participating or engaging in such activity in a park area. b`,~ Section 6. FORM OF PERMIT. The permit required by Section 5 shall. be in such form as may be established by the recreation dir- cetor. Section 7. APPLICATION. An application for a permit required by Section 5 shall contain the following items: (1) The name and address of the applicant. ' (2) The name and address of the person, corporation or association sponsoring the activity, if any. (3) The day and hours for which the permit is desired. (4) The park or portion thereof.for which such permit is desired. (5) An estimate of the anticipated attendance. (6) Any other information which the recreation director shall find reasonably necessary to a fair determination as to whether a permit should be issued. Section 8. STANDARDS FOR ISSUANCE, The recreation director or the Village Manager shall issue a permit hereunder when he finds: (1) That the proposed activity or use of the park will not unreasonably interfere with or detract from the general public enjoyment of the park. (2) 17tat the proposed activity or use will not un- reasonably interfere with or detract from the promotion , of public health, welfare, safety and recreation. (3) The the proposed activity or use is not reasonably anticipated to incite violence, crime or disorderly conduct. (4) That the proposed activity will not entail unusual, extraordinary or burdensome expense or police operation by the Village. (5) That the facilities desired have not been reserved for other use at the day and hour required in the application. Section 9. APPEAL FROM REFUSAL TO ISSUE. (1) Within five days after receipt of an application, the recreation director or Village Manager shall apprise an applicant iit writing of his reasons for refusing a permit. (2) Any aggrieved persons shall have the right to appeal i~t writing wit hin five days to the Village Council, which shall ' cwtsider the a pplication under the standards set forth in Section 8 and sustain or overrule the recreation director's or Village Manager's decision within seven days. - 2 - 6 e~ (3) The decision of the Village Council shall be final. Section 10. PERMITTEE -- BOUND BY RULES AND REGULATIONS. A permittee shall be bound by 811 park rules and regulations and all. applicable ordinances and provisions of this ordinance as fully as though the same were set out at length in the permit. Section 11. PERMITTEE -- LIABILITY FOR LOSS OR INJURY. T}re person to whom a permit is issued shall be liable for any loss, damage or injury sustained by any person whatever by reason of the negligence of the person to whom such permit shall have been issued. Section 12. REVOCATION. The recreation director may revoke ~ a permit upon a finding of a violation of any rule, ordinances or ~ rovisions of this Ordinance or u on ood cause shown. ~..~ P P g V V Section 13. OFFENSE ---FAILURE TO COOPERATE IN KEEPING RF.STROOMS NF,AT OR SANITARY. No person shall fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition. Section 14. OFFENSE ---DEFACING OR REMOVING IMPRONE- Mt;N7'S OR F.QI]IPMENT. No person shall wilfully mark, deface, dis- ' figure, injure, tamper with, or displace or remove, any buildings, bridges, tables, benches, fireplaces, railings, paving or paving material, water lines or other public utilities or parts of appur- tenances thereof, signs, notices or placards whether temporary or permanent, monuments, stakes, posts, or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal. Section 15. OFFENSE --- REMOVING NATURAL RESOURCES; EXCAVATIONS. No person shall dig or remove any beach sand, whether submerged or not, or any soil, rock, stones, trees, shrubs, or plants, down-timber or other wood or materials or make any excavation by tool, equipment, blasting or other means or agency. ' Section 16. OFFENSE --- ERECTING BUILDINGS OR STRUCTURES. No person shall construct or erect any building or structure of whatever kind, whether permanent or temporary in character, or run or string any public service utility into, upon or across, any public parks or recreational facilities except on special written permit issued hereunder. Section 17. OFFENSE --- INJURING TREES, ETC. (1) No person shall damage, cut, carve, transplant - 3 - ,....... fi-~ or remove any tree or plant or injure the bark, or pick the flowers or seeds, of any tree or plant. (2) No person shall attach any rope, wire or other con- trivance to any tree or plant. (3) No person shall dig in or otherwise disturb grass areas, or in any other way injure or impair the natural beauty or usefulness of any area. Section 18. OFFENSE --- CLIMBING TREES, ETC. No person s}iall climb any tree or walk, stand or sit upon monuments, vases, fountains, railings, fences, or guncarriages, or upon any other property not designated or customarily used for such purposes. Section 19. PENALTY. Any person convicted of the vio- lation of the terms of this ordinance shall be punished by a fine not to exceed $500.00 or by imprisonment not exceeding 60 days or by both such fine and imprisonment.
