Ordinance 196 Requirement for Dedicaiton of Subdivision Land for Parks~~ 1. ORDINANCE N0. 196-69 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACI{, FLORIDA, AMENDING T}tE REQUIREMENTS FOR PLATTING OF SUBDIVISIONS IN THE VILLAGE; AND SETTING FORTH REQUIREMENTS FOR T}{E DEDICATION OF SUBDIVISION LAND FOR PARKS, PLAYGROUNDS OR OTHER RECREATIONAL PURPOSES IN AN AMOUNT ' EQUAL TO FIVE PER CENT OF THE SUBDIVIDER'S TRACT FOR ALL LANDS }{ERF.- INAFTF.R PLATTED WITHIN THE VILLAGE; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEAC}{, FLORIDA: L'~ ~.. Section 1. The regulations for the platting of land and N r--~ development of subdivisions within the territorial limits of the Village V V oi' North Palm Beach, as set forth in Ordinance No. 25 of said Village, as supplemented and amended to date, are hereby further amended by the addition to said Ordinance No. 25 of a new section to be known as Section 17, and which said section shall read as follows: ' "Section 17. Dedication of Park Lands. Every plat of lands within the Village shall provide for a dedication to the Village of "useable land" equal in size to five per cent of the subdivision tract. This land shall be used by the Village for parks, playgrounds or for other recreational purposes as seems desirable by the Village Council. The term "useable land" shall mean land so located in relation to public streets or rights-of-way as to be accessible to the public and shall be of such grade and shape as to be useable by the Village for the purpose of parks, playgrounds'or other recreational facilities as is consistent with other parks, playgrounds or recreational facilities in t}ie Village of North Palm Beach existing at the time of dedication. a. If the Village Council determines that a suitable park, playground or other recreational facility of adequate size cannot be properly located in a plat or if the subdivided tract is less than twenty-five acres, the Village Council may require as a condition to approval of any such plat a payment to the Village of an amount equal to five per cent of the appraised value of the sub- division, which said money shall be used by the Village ' for parks, playgrounds or other recreational purposes in existing Village parks, as close to the platted property as possible, or can be used toward the ac- quisition of property for parks, playgrounds or other recreational facilities in the neighborhood of the subdivision." - 1 - Section 2. If any section, part of section, paragraph or clause of this ordinance shall be held to be unconstitutional or void, the remaining provisions of this ordinance shall nevertheless remain in full force and effect.
