Ordinance 173 Prohibits Sale of Cigarettes to Minors ORDINANCE N0. 173-68 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, PROHIBITING THE SALE, BARTER, FURNISHING OR GIFT TO ANY MINOR OF ANY CIGARETTES, CIGARETTE WRAPPERS OR SUBSTITUTE FOR EITHER, AND SETTING FORTH PENALTIES FOR VIOLATION OF THIS ORDINANCE, AND PROVIDING FOR PROCESS TO COMPEL MINORS WHO HAVE CIGARETTES OR CIGARETTE MATERIAL IN THEIR POSSESSION TO TESTIFY BEFORE A JUDGE AD LITEM OF THE VILLAGE OF NORTH PALM BEACH AS TO WHERE AND FROM WHOM THEY OBTAINED SUCH CIGARETTES OR CIGARETTE MATERIAL. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: J n Section 1. No person shall sell, barter, furnish or give away, directly or indirectly, to any person who is under seventeen (17) years of a.ge, any cigarette, cigarette wrapper or any substitute for either; or procure for, or persuade, advise, counsel or compel any child under said age to smoke any cigarette. Any person violating the provisions of this section shall, for the first offense, upon a, con- viction thereof, be fined not more than fifty dollars, nor less than ten dollars; and for a second and any subsequent offense, upon conviction thereof, be fined not more than one hundred dollars nor less than ten dollars, and to which ma.y be added imprisonment for any period not exceeding sixty days. Section 2. Any police officer shall enforce the provisions of this ordinance, and he ma.y summon any person who is under seventeen (17) years of age who ma.y have or have ha.d in his possession any cigarettes or cigarette material, and compel him to testify before any judge a.d litem of the Village of North Palm Beach a.s to where and from whom he obtained such cigarettes or cigarette material.
