Ordinance 182 Granting Power to Mayor to Proclaim State of Emergency Under Certain Specific Conditionsi3(i ORDINANCF. N0, 182-68 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, GRANTING POWER TO THE MAYOR TO PROCLAIM A STATE OF EMERGENCY UNDER CERTAIN SPECIFIED CONDITIONS. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, ' FLORIllA: Section 1. The Mayor of the Village of North Palm Beach be, and he is hereby, authorized to declare and determine by proclamation to that effect that an emergency situation exists within the Village of North Palm Reach upon any of the following factors: 1. The health, safety and well-being of persons within i}ie Village of North Palm Beach is threatened or endangered by the existence of disorder and civil disturbance within the Village of North Palm Reach. 2, The secure possession and use of property, and the free exercise of rights by persons within the Village of North Palm Beach is threatened and endangered by said disorder and civil disturbance. 3, The orderly functioning of the government of the Village of North Palm Beach is interfered with or disrupted or threatened with interference or disruption by said disorder and civil disturbance. Section 2. In the event that the Mayor proclaims an emergency in accordance with Section 1 of this Ordinance, then the following emergency regulations may be ordered and directed to take effect immediately; 1. That a curfew be declared in the Village of North Palm Reach beginning and ending at a time to be specified by the Mayor under t}~e circumstances involved daily until further notice. All persons ocher than law enforcement officers, firemen, physicians, nurses and , medical personnel, and employees of the Village of North Palm Beach llepartment of Sanitary Engineering shall be off the streets and away from public places within said area during the period of the curfew. ~~_ Ordinance No. 182-68 Yage 7tao 2. That the following activities in the Village of North Palm Beach may be prohibited: (a) The sale or dispensing of alcoholic beverages, in- eluding beer and wine; (b) The sale or dispensing of gasoline or other in- fl.anunable materials or liquids except when dispensed and delivered directly into the main and customary tank of a motor vehicle; and (c) The sale, gift or exchange of any firearms or anumznition. ~ 3. That no persons except law enforcement officers, N shall possess or carry firearms, ammunition, explosives, inflammable r-~ (Uj materials or LicRxids other than in the main and customary tank of a motor ve}iicle, or other dangerous weapons within the Village of North Palm Beach. Section 3. The violation of any emergency proclamation shall be punished as a misdemeanor and the violator may be fined in the municipal court in a stun not to exceed $500 or be imprisoned for a period riot io exceed sixty days, or by both such fine and imprisonment. Section 4. The emergency proclamation may take effect inunediately and shall extend until the Mayor proclaims the termination of said emergency.
