Ordinance 180 Creating New Zone R-2-A Multiple Family Dwelling District[) ORDINANCE N0. 180-68 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEAC}{, FLORIDA, U I.f~ N r-~ V V AMENDING ORDINANCE N0, 20, AS HERETOFORE AMENDED, THE SAME BEING THE COP}PREHENSIVE ZONING ORDINANCE OF SAID VILLAGE, BY CREATING NEW 'LONE "R-2-A - LIMITED MULTIPLE FAMILY DWELLING DISTRICT", BY RA~}OVING CERTAIN PROPERTY FROM THE P - PUBLIC DISTRICT AND RE- CLASSIFYING SAID PROPERTY AS R-2-A LIMITED MULTIPLE FAMILY DWELLING DISTRICT; BY DIRECTING THE VILLAGE CLERK TO BRING THE OFFICIAL ZONING MAP UP TO DATE; BY PROVIDING FOR THE REPEAL OF ORDINANCES IN CON- FLICT HEREWITH AND FOR OTHER PURPOSES, BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORT}{ PALM BEAC}{, FLORIDA: Section 1. Ordinance No. 20 of the Village of North 1 Palm Beach, as amended, is hereby further amended in Section 3 thereof by adding an additional zoning district to be entitled R- 2-A; by inserting the words "R-2-A - Limited Multiple Family Dwelling District", between the designation of R-2 Multiple Family Dwelling District and R-2 Apartment Dwelling District in said Section 3. Section 2. Ordinance No. 20 of the Village of North Palm Beach, as amended, is hereby further amended by adding thereto Section 18, to read as follows: "SF,CTION 18. R-2-A LIMITED MULTIPLE FAMILY DWELLING DISTRICT A. PERMITTED PRINCIPAL AND ACCESSORY USES AND STRUCTURES: No building, structure, land or water shall be used on u the property except for multiple-family dwelling structures. B. AREA REGULATIONS: 1. Front Setback A11 buildings and structures shall be set back at least SO feet measured from the right-of-way line of U. S. Highway No. 1 to the front of any building or structure located on the property. c~ Ordinance: No. 180-68 Page two 2. SIDE YARD There shall be a side yard of not less than 15 feet for each building, with a minimum side yard of at least thirty feet between any two buildings. 3. REAR YARD There shall be a rear yard of not less than 25 feet measured from the property line of the North Palm Beach Country Club to the rear building line of any building or structure located on the property. C. BUILDING SITE AREA REGULATIONS: For each multiple-family structure the minimum building site area shall be 10,000 square feet and have a width of not less than 75 feet. D. MAXIMUM SITE AREA COVERAGE: All dwellings and buildings accessory thereto shall cover not more than 35% of the site area. The site area shall be determined by excluding therefrom any access road on the property. E. }{EIGHT REGULATIONS: No building shall exceed two stories in height or 30 feet in height, whichever is less, and no accessory building may be more than one story high. F. OFF-STREET PARKING: There shall be a minimum of one and one-half parking spaces for each dwelling unit located on the site. All regulations concerning off-street parking, including the layout, construction, maintenance shall be determined by the existing zoning ordinances of the Village of North Palm Beach. G. FLOOR AREA REGULATIONS: Each dwelling unit shall have a minimum area as follows: 1 Bedroom Units shall have a minimum floor area of .660 square feet and an additional 140 square feet of floor area shall be provided for each additional bedroom provided. Il. UTILITY SERVICE: 1 1 1 All utility service for the site area shall be provided underground, and there shall be no utility poles situated on the site area." ~a Ordinance No. 180-68 Page three Section 3. S. Highway No. 1) as shown on State Road Department's Right of Way Map, recorded Road Plat Book 2, Pages 105 to 118, inclusive, Public Records of Palm Beach County, Florida, with the southwesterly right of way line of the Intracoastal Waterway, as shown lf~ on Florida Inland Navigation District's Right of ~`' Way Map, recorded in Plat Book 17, Page 10, N Public Records of Palm Beach County, Florida, run `~ V South 90-55'-13" West along said westerly right of V way line of State Road No. 5, a distance of 400 feet to the POINT OF BEGINNING and the northeasterly corner of the parcel of land herein described; thence continue along the same course, South 90-55'-13" West and along said westerly right of way line, a distance of 483.75 feet to the beginning of a curve concave to the east and having a radius of 2924.93 feet; thence southerly along the arc of said curve, and along said westerly right of way line, a distance of 691.00 feet; thence westerly and northerly along the arc of a curve concave to the northeast having a radius of 190 feet and whose tangent makes an angle with the tangent to the preceding described curve, at the point of intersection, measured from south to west of 910-51'-41", a distance of 304.62 feet to the end of said curve; thence North 0°-06'-25" East, along the tangent of said curve; a distance of 384.81 feet; thence North 90-55'-13" East, parallel to the westerly right of way line of said State Road No. 5, a distance of 425.49 feet to the beginning of a curve concave to the southeast and having a radius of 210 feet and a central angle of 90°-0'; thence northerly and easterly along the arc of .said curve, a distance of 329.87 feet to the POINT OF BEGINNING in said westerly right of way-line of State Road No. 5; said parcel containing 5.23 acres. Less the following described property: A parcel of land in Section 9, Township 42 South, Range 43 East, Palm Beach County, Florida, more particularly described as follows: From the intersection of .the westerly right of ' way line of U. S. Highway No. 1 with the southerly right of way line of the Intracoastal Waterway, run South 11°-54'-40" West along said westerly right of way line, a distance of 883.75 feet to '~ 6 Ordinance No. 180-68 Page four the beginning of a curve concave to the east, having a radius of 2924.93 feet and a central ' angle of 31°-31'-40"; thence southerly along the arc of said curve and through an angle of 7°-56'- 57", a distance of 405.80 feet to the Point of Beginning of the parcel of land hereinafter ' described; thence continue southerly along the arc of said curve and through an angle~bf 5°-35'-12" a distance of 285.20 feet and the beginning of a curve concave to the northeast having a radius of 190 feet and a central angle of 91°-Sl'-41" and whose tangent at this point makes an angle with the tangent to the-preceding described curve, measured from south to west of 91°-51'-40"; thence westerly, northwesterly and northerly along the arc of said curve, a distance of 30~}. 62 feet to the end of said curve; thence North 2°-OS'-52" East, a distance of 98.90 feet; thence South 86°-47'-0"-East, a distance of 191.59 feet, more or less, tb:-the Point of Begin- ning; the above described parcel of land contains 1.08 acres. NOTE: The above mentioned bearings are referred to the south right of way line of the Intra- coastal Waterway which bears North 59°-06'-15" West and recorded in Plat Book 17,~Page 10, Public Records of Palm Beach County, Florida. , Said land shall henceforth be classified R-2-A Limited Multiple Family Dwelling District. Section 4. The Village Clerk is hereby authorized and directed to reflect upon the official zoning map by hatching or other appropriate means of designation the change in zoning classification effected under this amending ordinance. Section 5. All ordinances or parts of ordinances in con- flict herewith be and the same are hereby repealed. Section G.
