AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REPEALING
ORDINANCE N0. 48 AND AMENDING ORDINANCE N0. 20, THE COMPREHENSIVE ZONING ORDINANCE,
BY LIMITING THE PROXIMITY OF GASOLINE OR OIL STATIONS TO CERTAIN STRUCTURES OR TO OTHER
SUCH STATIONS WITHIN THE VILLAGE OF NORTH PALM BEACH.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PAT~M BEACH, FLORIDA:
Section 1. Ordinance No. 48 of the Village of North Palm Beach be,
and the same is hereby, repealed.
Section 2. Ordinance No. 20 of the Village of North Palm Beach, it being
the comprehensive zoning ordinance a.s heretofore amended, be and the same is hereby
further amended by adding an additional section thereto to read as follows:
"Section 17. No gasoline or oil filling station and no =
service station shall be erected, within 500 feet of any church,
hospital, school or other similar institution where large numbers
of pedestrians congregate, nor within 1000 feet of_the location
in said Village of another gasoline or oil fi11_ing or service -
sta.tion.

The method of measurement that shall apply in such cases shall be
by measurement of the airline distance made or taken from the
nearest boundary of the lot or premises where such proposed
station would be 1oca.ted to such building or structure used a.s a.
church, hospital, school or other similar institution to the -
boundary of the lot or premises where the existing station i.s
erected. Nothing in this section shall prohibit, however:
(a) the operation of existing gasoline or oil filling
stations or service stations,
(b) the improvement, alteration or reconstruction of
any presently existing gasoline or oil filling station or
service station,
(c) the construction of gasoline or oil filling stations
• or service stations for which permits have been issued prior
to the date of this ordinance, but which a.re not presently
under construction."
