2003-23 Amends Code on Sidewalks, Parking & DrivewaysORDINANCE 23-2003 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM _ BEACH, FLORIDA, AMENDING VARIOUS SECTIONS OF THF, CODE OF ORDINANCES OF THE VILLAGE RELATING TO SIDEWALKS, OFF-STREET PARKING SPACES AND DRIVEWAYS; AMENDING SUBSECTION "BUILDINGS, STRUCTURES"' OF 307.4, CARE OF PREMISES, AND ADDING A SECTION 101.3.4 TO SECTION 15-2. SAMF.,- AMENDMENTS, OF CHAPTER 15, HOUSING; AMENDING SUBSECTIONS (a)(1) AND (c) OF SECTION 24-43, SPECIFICATIONS, OF AR"I'ICLE III, SIDEWALKS AND DRIVEWAYS, OF CHAPTER 24, STREETS, SIDEWALKS AND PUBLIC PLACES; REPEALING SECTION 24-45, INSPECTION FEES; DEPOSITS PENDING APPROVAL; AMENDING SUBSECTION E, OFF-STREET PARKING REGULATIONS, OF SECTION 45-27, R-I SINGLE-FAMILY DWELLING DISTRICT, OF ARTICLE III, OF APPENDIX C- ZONING; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATF,. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACI-I, FLORIDA: Section I. Subsection "Buildings, Structures" of 307.4, Care of Premises, of Section 15-2, Same-Amendments, of Chapter I5, Housing, of the Code of Ordinances of the Village is hereby amended to read as follows: "Buildings, Structures The exterior of all premises and every structure thereon where exposed to public view, shall be maintained in a condition that shall not show evidence of deterioration. All screened enclosures shall be properly fitted and maintained. All surfaces shall be maintained free of weathering, discoloration, ripping, tearing or other holes or breaks, broken glass, crumbling stone, brick or stucco or other conditions reflective of deterioration or inadequate maintenance. All building exterior wall surfaces shall be kept free of faded or chipped paint and shall be maintained in repair and condition to prevent deterioration, and must be repainted, recovered or cleaned when twenty-five (25) percent or more of any exposed surface becomes discolored or is peeling. All off-street parking spaces and driveways shall be asphalt, concrete, block, stone, brick or similar smooth durable surface or durable surface as approved by the Public Services Director. All off-street parking and driveways shall be kept in good repair and sound structural condition. Asphalt, concrete, and brick paver surfaces shall not show signs of excessive surface deterioration, such as potholes and substantial cracks. All driveways shall be free of errant vegetation. Stone surface driveways shall be maintained in a neat appearance and bordered. Stone material shall be so '-` maintained as to not spread onto public streets and sidewalks." Section 2. Subsection 101.3.4 to Section 15-2, Same-Amendments, of Chapter 15, Housing, of the Code of Ordinances of the Village, is hereby added and to read as follows: "101.3.4. All residential properties, buildings and structures annexed into the Village shall comply, upon annexation, with the requirements of Chapter 15, Housing, Sections 15-1 and 15-2, with the following exception: The provisions of Subsection 307.4 shall apply 2 years (24 months) after date of annexation." Section 3. Subsections (a)(1) and (c) of Section 24-43, Specifications, of Article III. Sidewalks and Driveways, of Chapter 24, Streets, Sidewalks and Public Places, of the Code of Ordinances of the Village, is hereby amended to read as follows: "Section 24-43. Specifications. (a) Generally. Sidewalks and driveways shall be constructed in accordance with the following specifications: (1) Sidewalks and the driveway between the street and sidewalk or property line shall be constructed of Portland cement concrete, using durable materials in such proportions that a hard dense product with a minimum twenty-eight day strength of two thousand five hundred (2,500) pounds per square inch. (c) Driveways. In addition to the specifications set forth in paragraph (a) of this section, driveways between the street and sidewalk or property line shall conform to the following specifications: (1) Minimum of six (6) inches in thickness, including the sidewalk section, with edges thickened to a minimum of eight (8) inches. (2) Minimum of eight (8) feet wide at the sidewalk and shall flare uniformly to a width of fourteen (14) feet at the edge of the paving, unless extenuating circumstances as determined by the building official suggest a variance of this flare width, and in such instances the flare requirements shall be determined by the building official. (3) The profile shall follow the roadside Swale so as not to interfere with drainage.' Section 4. Section 24-45. Inspection fees; deposits pending approval, of Article III, Sidewalks and Driveways, of Chapter 24, Streets, Sidewalks and Public Places, is hereby ,_,. repealed in its entirety. Section 5. Subsection E, Off-Street Parking Regulations, of Section 45-27, R-1 Single-Family Dwelling District, of Article III of Appendix GZoning, is hereby amended to read as follows: "Section 45-27. R-1 Single family dwelling district. E. Off street parking regulations. At least one parking space of at least two hundred (200) square feet shall be provided. All parking spaces shall consist of a durable surfaced area as approved by the Public Services Director, enclosed in the dwelling, in an accessory building or in an unenclosed area, exclusive of the driveway, connecting the parking space to the street. All vehicles parking on a lot must be parked on a durable surface." Section 6. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 7. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 8. This Ordinance shall take effect immediately upon passage.
