Ordinance 117 Creation of Library Advisory Board ORDINANCE N0. ~-1965 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, CREATING A VILLAGE LIBRARY BOARD SETTING FORTH THE MEMBERS THEREOF, THEIR DUTIES AND QUALIFICATIONS AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. # ~ * ~ ~ BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. There is hereby established a library board hereinafter referred to as aboard! for the Village of North Palm Beach. The board shall consist of five (5) members who shall be appointed by the Village Council. Two (2) members of the board initially appointed shall serve until the date of the first meeting of the Village Council in May, 1966. Three (3) members of the board initially appointed shall serve until the date of the first meeting of the Village Council in May, 196'7. Thereafter members shall be appointed for a term of two years or until their successors have been appointed and qualified. In the case of vacancy by resignation, removal or otherwise, the Village Council shall fill such vacancy for the unexpired term. Section 2. Members of the board shall be residents of the Village; however, neither u the mayor nor any member o£ the Village Council shall be eligible to be a member of the board. No member o£ the board shall receive any pay or compensation for any services rendered as a member of such board. The members of the board shall, immediatelq after their appointment, meet and organise by electing one of their members as chairman and such other officers as the board may deem necessary. Section 3. Three (3) members of the board shall constitute a quorum. The board may make and adopt such by-laws, rules and regulations for their own guidance and for the government and operation of any municipal library and reading room in the Village as they may deem expedient, subject to the approval, supervision and control of the Village Council and not inconsistent with law. Section 4. Subject to the control and direction of the Village Cotuacil, the board: (a} Shall act in an advisory capacity (nonadministrative) to the Village Council, to assure representation of the ideas of citizens and taxpayers of the Village relative to the functions and operation of a municipal library and reading rooms in the Village, and such advisory assistance shall include, but not be limited to, recommendations relative to control of expenditures of moneys collected, or donated to the credit of a municipal library in this Village, and the supervision, care and custody of the grounds, rooms, property and buildings constructed, leased, or set aside £or municipal library purposes. (b) Shall make recommendations for the appointment of a suitable 7.ibrarian and assis- tents and their respective rates of compensation; establish regulations for the government and control of a municipal library as may be deemed necessary for its preservation and to maintain its usefulness and efficiency; fix and impose by general rules, penalties and Forfeitures For failure to return any book or for violation of any by-laws or• regulation of the board. • ORDIPIANCE N0. ~-1965 Page -2- ' (c) Shai1 annually in an advisory capacity assist the Village Manager in preparing a budget £or the maintenance and.expansiorL-of municipal library facilities. (d} Shall keep records, inventories and accounts, budgetary or otherwise, of all of the activities of the board and the municipal library system and make annual reports to the Village Manager and the Village Council relative thereto or whenever requested to do so be the council. Section 5, In the performance of their duties set forth in this ordinance, the board shall hold at least one (1) regular meeting every two months. Special meetings may be called by the board chairman upon prior notification. Minutes shall be kept during all meetings and • a copy given to the Village Manager and the Village Couneil. Section 6. Member s of the board may be removed by an affirmative vote of a majority of the total members of the Village Council. Section 7. It is hereby declared unlawful for any person to trespass, cause injury to, or to destroy any library grounds, rooms, books or other property constituting a part of the municipal library system of the Village or to violate any of the by-laws or regulation adopted by the library board and approved by the Village Council relative to operation of said municipal library system. Any person or persons found guilty of violating this section ' shall be punished by fine of not less than five dollars 05.00) nor more than five hundred dollars 0500.00), or by imprisonment not exceeding ninety (90) days, or both such fine and imprisonment, at the discretion of the court, FIRST READING the 9th day of March, 1965.
