AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING SECTION 2-115, RESIDENCY, AND SECTION 2-116,
REMOVAL, OF ARTICLE IV, MANAGER, OF CHAPTER 2, ADMINISTRATION, OF THE
CODE OF ORDINANCES OF THE VILLAGE TO PROVIDE THAT THE VILLAGE
MANAGER ATTAIN RESIDENCE WITHIN THE VILLAGE LIMITS WITHIN ONE HUNDRED
TWENTY (120) DAYS OF HIS APPOINTMENT AND RETAIN VILLAGE RESIDENCE
DURING HIS PERIOD OF APPOINTMENT AND TO PROVIDE FOR TERMINATION
BENEFITS OF THE VILLAGE MANAGER WHEN-THE VILLAGE MANAGER IS REMOVED
FROM OFFICE BY THE VILLAGE COUNCIL WITHOUT GOOD CAUSE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. Section 2-115, Residency, of Article IV, Manager, of Chapter 2, Administration, of
the Code of Ordinances of the Village is hereby amended to read as follows:
"Section 2-115. Residency
At the time of his appointment the village manager need not be a resident of
the village or state, but shall attain residence within the village limits within one
hundred twenty (120) days of his appointment and retain village residence during his
period of appointment."
Section 2. Section 2-116, Removal, of Article IV, Manager, of Chapter 2, Administration, ofthe
Code of Ordinances of the Village is hereby amended to read as follows:
"Section 2-116. Removal
The village council may remove the village manager at any time by a majority
vote of the members. In the event the village manager is removed from office by the
village council. without good cause during a time that the village manager is willing
and able to perform his duties, then, in that event, the village shall pay the village
manager the following:
(1) Accumulated sick leave and accumulated vacation pay; and
(2) Continuation of manager's salary and related insurance benefits under
this agreement for a period of:
(a) three (3) months if the termination occurs during the first six
(6) months of this contract;
(b) six (6) months if the termination occurs thereafter; and
