2004-23 Amends the Duties of the Recreation Advisory BoardORDINANCE 23-2004
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING SUBSECTION (a) OF SECTION 20-66, DUTIES, OF
• ARTICLE III, RECREATION ADVISORY BOARD, OF CHAPTER 20, PARKS,
PLAYGROUNDS AND RECREATION, OF THE CODE OF ORDINANCES OF THE
VILLAGE BY DELETING THE REQUIREMENT THAT THE BOARD MAKE
RECOMMENDATIONS TO THE VILLAGE COUNCIL AS TO VILLAGE WATERWAYS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND,
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. Subsection (a) of Section 20-66, Duties, of Article III, Recreation Advisory
Board, of Chapter 20, Parks, Playgrounds and Recreation, of the Code of Ordinances of the
Village is hereby amended to read as follows:
"Section 20-66. Duties.
(a) The board shall serve in an advisory capacity to the village council and make
recommendations as to present and future recreation activities, planning, recreation
programs, capital improvements and facilities and other matters relating to the overall
recreational activity of the village other than its waterways. The board is not charged
with the duty of ascertaining costs or method of implementation of their proposed
plans; however, the board should consider the needs of all residents of the village.
The board shall have the power to call upon the village manager, or his designee, for
information and advice. The board's recommendations to the village council shall be
in writing and shall state the basis or reasons for such recommendations."
Section 2. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for
any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not
affect the remainder of this Ordinance.
Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
Section 4. This Ordinance shall take effect immediately upon passage.
