AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING SECTION 25-3, PERMITS, AND SECTION 25-4,
CONSTRUCTION, OF ARTICLE I OF CHAPTER 25, SWIMMING POOLS, OF THE CODE
~+ OF ORDINANCES OF THE VILLAGE, WHICH AMENDMENTS ARE FOR THE PURPOSE
OF PROVIDING FOR AND ALLOWING FIBERGLASS SWIMMING POOLS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. Section 25-3, Permits, of Article I of Chapter 25, Swimming Pools, of the Code of
Ordinances of the Village, is hereby amended to read as follows:
"Section 25-3. Permits.
Applications for swimming pool permits shall be accompanied by payment of a fee in
accordance with village ordinances, and by plans and specifications prepared by a
competent engineer registered in the State of Florida. The design of fiberglass pools
shall specifically address uplift."
Section 2. Section 25-4, Construction, of Article I of Chapter 25, Swimming Pools, of the
Code of Ordinances of the Village, is hereby amended to read as follows:
"Section 25-4. Construction.
Private and public pools shall be constructed of reinforced concrete, concrete block
reinforced and poured after laying up, reinforced gunite construction, or fiberglass.
Product approval is required by an approved testing agency for fiberglass pools.''
Section 3. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for
any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not
affect the remainder of this Ordinance.
Section 4. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
Section 5. This Ordinance shall take effect immediately upon passage.
