AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ORDINANCE N0. 98,
SAID ORDINANCE ANNEXING CERTAIN LAND; BY PROVIDING A MORE COMPLETE LEGAL DESCRIPTION OF PROPERTY
TO BE ANNEXED, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH.

WHEREAS, The Charter of the Village provides in Article V, Section 29, as follows:
"Upon petition of the owner or owners of any lands adjoining
' or within two (2) miles of the territorial boundaries of said
municipality, to annex such lands by ordinance to the territor-
ial limits of the municipality hereby established, upon the
petition of the owner or owners thereof aad in accordance with
the power and authority hereby given, then such land so annexed
shall be and become a part of the municipality hereby established
with the same force and effect as though the same had been orig-
inally incorporated in the territorial boundaries thereof,"
and
WHEREAS, the following petition has been received by the Village Counci:

Gentldmen:
As owner of the following described property, I hereby request that the
V><llage of North Palm Beach annex this property into the corporate limits
of the Village of North Palm Beach:
Legal Description of property:
The West half of the "Not Included" Parcel as shown on the
plat to FAIRHAVEN ADDITION TO VILLAGE OF NORTH PALM BEACH,
as recorded in Plat Book 2'7, at Page 90 in and for the records
of Palm Beach County, Florida.
The entrance of these lots into the Village o£ North Palm
Beach will create five (5) additional residential lots in
what will be a re-plat of 'the FAIRHAVEN ADDITION to the
Village of North Palm Beach,
Enclosed find copy of survey dated 12 May 1964 which gives a
more accurate description of the property.

and WHEREAS, It appears said land is owned by said persons and is geographically so
' located as to comply with the Charter provision above quoted and should be annexed by the
Village;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA:

Section 1. The following land in Palm Beach County, Florida, be and it is
hereby annexed to the Village of North Palm Beach, Florida;
FAIRHAVEN ADDITION NO 2 TO VILLAGE OF NORTH PALM BEACH
A parcel of land in Section 17, Township 42 South, Range 43 East,
Palm Beach County, Florida, more particularly described as follows,
to wit:
Being a replat of a portion of FAIRHAVEN ADDITION to VILLAGE OF
NORTH PALM BEACH, as recorded in Plat Book 27, Page 90, Public
Records of Palm Beach Oounty, Florida, and a portion of "Not
Included" parcel shown on said plat, beginning at a point which
is the Northeast corner of Lot 1, according to the Plat of FAIR-
HAVEN ADDITION aforesaid, thence, South 88 24' and 29" E, a
distance of 208.05 feet to a point; thence S 1° 31' 12" W a
distance of 256.98 feet to a point; thence, Southerly and Westerly
along the arc of a curve concave to the Northwest, having a radius
of 25 feet and a central angle of 90° 1' S7° a distance of 39.28
feet to a point; thence, N 88° 26' S1* W a distance of 158.11 feet
• to a point; thence, Westerly and Northerly along the arc of a
curve concave to the Northeast, having a radius of 25 feet and a
central angle of 89° 58' 41" a distance of 39.26 feet to a point;
thence, N 1° 31' S0~ E a distance of 257.1.1,. feet to the Point of
Beginning.
Section 2. Such land shal]. hereafter be a part of the municipality of North
Palm Beach with the same force and effect as though the same had been originally incor-
porated in the Village territorial boundaries.
Section 3. All ordinances or parts of ordinances in conflict herewith are
' hereby repealed.
FIRST READING the 28th day of July, 1164.
SECOND, FINAL READING AND PASSAGE the 28th day of duly, 1964.
