ORDINANCE N0, 100 - 1964
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, PROVIDING THAT IT
SHALL $E UNLAWFUL FOR ANY PERSONS, FIRM, PARTNERSHIP OR CORPORATION TO USE WITHIN THE
VILLAGE OF NORTH PALM BEACH, FLORIDA, THE PESTICIDE KNOWN AS PARATHION OR ANY OTHER
PHOSPHATIC PECTICIDE HEREBY LISTED AND NOT HAVING LABEL APPROVAL TO USE ON LAWNS, TURFS
OA ORNAMENTAL PLANTS UNLESS OTHERWISE PROVIDED.

WHEREAS, the Village Couneil after investigation, has found and determined that
the following chemical pesticides are extremely toxic and not only endanger the health and
life of the user of the pesticide, but also the public generally who come in contact there-
with; and
WHEREAS, the Village Council has found and determined that these chemical
pesticides are being used on lawns, turf and ornamental plants where label approval has
not been registered £or such use by the State Commissioner of Agriculture or the U.S.
Department of Agriculture, and thereby creating a continuous hazard to the health and
lives of the citizens of North Palm Beseh, Florida; and
WHEREAS, the Village Council has determined that commercial lawn spray men

should not be given an occupational license to engage in this business until an inspection
has been made of the equipment, facilities, and ability of the spray men to handle these
dangerous and extremely toxic pesticides;
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL NORTH PALM BEACH, FLORIDA;
Section 1. That it shall be unlawful £or any person, partnership, firm or

corporation to use within the Village of North Palm Beach, Florida, the following listed
chemical pesticides in any form on lawns, turfs or ornamental plants:

Parathion 0, 0-diethyl 0-p-nitrophenyl thiophosphate.
Phorate (Thimet) 0, 0-diethyl S-(ethylthio)methyl phosphorodithioate.
Demeton (Systox) 0, 0-diethyl 0(andS}_2_(ethylthio) ethyl phosphorothioate.
Di-Syston 0, 0-diethyl S-2(ethylthio) -ethyl phosphorothioate.
Phosdrin 2-carbomethoxy-l-methylvinyl dimethyl phosphate.
Sclu•adan Octamethyl pyrophosphoramide.
Guthion 0, Odimethyl S-(4-oxo-1, 2, 3-benzotriazi~pl-3 methyl) phosphoro-
thioate.
Methyl Parathion 0, 0-dimethyl 0-p-nitrophenyl thiophosphate.
Endrin Hexachloroepoxyocatahydro-endo, endo-dimethanonaphthalene.
Potasan 0, 0-diethyl 0-(4-methylumbelliferone) phosphorothioate.
Epn 0-ethyl 0-p-nitrophenyl benzenephosphonothioate.

Section 2, That before a license shall be given to any commercial lawn spray a
man to engage in the occupation of commercial lawn spray man, the applicant for the license
shall present himself to the Palm Beach County Health Department in West Palm Beach, Florida,
to determine whether his vehicle complies with the rules and regulations of the Florida State
Board of Health regarding cross connections, identification of vehicle, locked compartment
for storage and disposal of containers, available masks, protective clothing such as rubber
boots, etc,, and until the individual has demonstrated to the officials of the Florida State
Board of Health that he has sufficient knowledge of the rules and regulations of the Florida
State Board of Health regarding lawn spraying so as not to endanger the health, lives and
welfare of the residents and citizens o£ the Village of North Palm Beach. Any applicant for

a commercial lawn spray mans license who has been so examined and whose examination has been
approved by the Palm Beach County Health Department, in writing, shall then be granted a
license to engage in the occupation of a commercial Lawn spray man. Failure to so obtain
the approval of the Palm Beach County Health Department shall result in the application for
license being denied.
Section 3, That all Ordinances in conflict herewith are hereby repealed and this
Ordinance is made cumulative with ell other Ordinances of the Village of North Palm Beach,
Florida.
Section 4. That if any section, sub-section, sentence, clause or phrase of this
Ordinance, for any reason, is held to be unconstitutional, void, or invalid, the validity
of the remaining portions of this Ordinance shall not be affected thereby.
Section 5. That this Ordinance is hereby declared to be a necessary measure in
conformity with the State pesticide registration laws, and necessary for the preservation
of the peace, safety, health and general welfare of the citizens o£ North Palm Beach,
Florida, and shall take effect upon its passage.
