Ordinance 094 Amendment to Ord. #28 - Regulation of Dogs ORDINANCE #~ AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH COUNTY, FLORIDA, AMENDING ORDINANCE N0. 2S, SAID ORDINANCE PROVIDING FOR THE REGULATING OF DOGS, BY SETTING FORTH PENALTY FOR FAILURE TO HAVE DOG LICENSED; BY REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE HEREOF. i HE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM HEACH, FLORIDA, as follows: Section 1, That Ordinance No. 2S, entitled "AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, PROVIDING FOR THE LICENSING OF ALL DOGS WITHIN THE CORPORATE LIMITS OF SAID VILLAGE; :PROVIDING FOR RABIES INOCiTLATION AS A PREREQUISITE TO SUCH LICENSING; PROHIBITING DOGS AND CATS FROM RUNNING AT LARGE; AUTHORIZING THE IMPOUNDING OF DOGS UNDER CERTAIN CIRCUMSTANCES; PROVIDING FOR THE REDEMPTION OF IMPOUNDED DOGS AND FOR THE DISPOSITION OF UNCLAIMED DOGS; PROVIDING FOR THE ENFORCEMENT OF THIS ORDINANCE; ESTABLISH- ING PENALTIES FOR VIOLATION OF THE PROVISIONS THEREOF; AND REPEALING ALL ORDINANCES OR FARTS OF ORDINANCES IN CONFLICT THEREWITH," :is hereby amended as set forth below: Section 2. Section 2 of Urdinance No. 2$, be, and the same is hereby, amended to read as follows: ~~Section 2. Duts to Register and License, Every owner who keeps, harbors, or r~ lJ otherwise maintains a dog more than sit (6) months _o£ age in the Village shall register such dog and procure a license for the same not later than the first day of June in each license year, Any dog purchased or otherwise <acquired or newly brought into the Village to be main- twined by its owner in accordance with this ordinance, after the first day of June in any license year shall also be registered and licensed as provided herein not later than thirty (30) days after the same is purchased or otherwise acquired or newly brought into the Village to be maintained by ita owner in accordance with this ordinance, and aryy dog less than six (6) months of age shall also be registered and licensed as provided herein not later than thirty (30) days after the same becomes six (6) months of age." Section 3. Section 4 of Ordinance 28 be, and the same is hereby, amended to read as follows: ~~Section 4. Annual License Fee. The license fee for each dog registered shall be One Dollar 01.00) for each license year or any fraction thereof. The owner of any dog which has not been registered and licensed in accordance with the provisions of this Ordi- rtance shall be penalized the sum of Ten Dollars (,10.00} and shall also comply with the terms of this Ordinance by acquiring a license at a cost of One Dollar 01.00), in addition to the penalty.~~ ®RDINAIv~E N0.2 PAGE 2 , Section 4. Section 15 of Ordinance No. 2S be, and the same is hereby, amended to i. ~ read as follow: "Section 15, Redemption of Impounded Dogs, The impounding of dogs under the provisions of this ordinance shall be carried out by the Animal Rescue League of Palm Beach County, Florida, at the direction and request of the Chief of Police, or such other person as may be charged with the enforcement of this ordinance under Section 20 below. All dogs shall be impounded at the facilities provided by the Animal Rescue League for such purposes, and which are situated at 2401 North Tamarind Avenue in the City of West Palm Beach, Florida. "The Chief of Police shall maintain a record of each dog so impounded, which said record is to reflect the breed, color, and sex of such dog and whether licensed. If licensed, the name, address and telephone number of the owner and the number of the license tag shall also be entered upon such record. "Not later than twenty-four (24) hours after the impounding of ax~p dog, the owner shall be notified by mail, or i£ the owner of the dog is unlmown, notice shall be posted at the Village Hall describing the dog and the time and place of taking. "The owner of any licensed dog so impounded or the person claiming to be the owner J of any unlicensed dog may redeem such dog in accordance with the provisions of this ordinance upon payment o£ the license fee, if unpaid, together with a fee to cover the costs o£ impound- ing such dog in the sum of Ten Dollars 010.00) and a-maintenance charge of Two Dollars($2.00) for each day or fraction thereof that such dog is impounded provided, however, that in the case of an unlicensed dog being impounded, the penalty o£ Ten Dollars 010.00) set forth in Section 4, hereof, shall not be assessed against the owner of said dog.
