Ordinance 081 Village Manager Qualifications & Duties ORDINANCE N0. 81 ' AN ORDINANCE OF TEIE VILLAGE OF NORTH PALM BEACH, FLORIDA, PRESCRIBING THE QUALIFICATIONS AND DUTIES AND OTHER MATTERS RESPECTING THE OFFICE OF VILLAGE MANAGER OF SUCH VILLAGE; REPEALING ALL ORDINANCES IN CONFLICT HERE}VITH AND FOR OTHER PURPOSES. ** ** ** ** ** ** i4HEREAS, by the Charter of the Village of North Palm Beach, the government of said Village is vested in the Village Council, but the Council • has the power and authority under said Charter to " * employ or appoint some person or one of its own members as a Village Manager and to prescribe his powers and duties. The Manager shall be the administrative head of the municipal government but shall be subject to the direction and supervision of the Council. The Manager shall be chosen solely on the basis of his executive and administrative qualifications and he need not be a resident of the Village. The Manager shall receive such compensation as shall be fixed by resolution of the Council and shall hold office during the pleasure of the Council. * *"; an d 1VHEREAS, it is the purpose of this ordinance specifically to set ' forth the qualifications and duties and other matters respecting the office of the Village Manager which was created by Resolution #17 of the Village Council adopted on January 28, 1957; NOiV, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA: Section 1. Creation of office. The office of Village Manager is hereby created. Section 2. Appoitttment of Village Alanag er. The Village Manager shall be appointed by majority vote of the Village Coun cil for an indefinite term. He shall be chosen by the Council solely on the basis of his executive qualifications wit h special reference to his actual exp erience in or his know- ledge of accepted practice in respect to the duties of his office hereinafter set forth. At the time of his appointment he need not be a resident of the Village or State, but shall attain residence within the Village within 60 days ' of his appointmnet and retain Village residence during his period of appointment. n L.J • Section 3. Removal of Village Manager. The Village Council may remove the Village Dfanager at any time by a majority vote of its members, and shall pay his salary for one calendar month following the removal date and such ' payment shall relieve the Village of all obligations to the Manager including accrued vacation time. Section 4. Powers and Duties of Village Manager. The Village Manager shall be the chief administrative officer of the Village. He may head one or more departments and shall be responsible to the Village Council for the proper administration of all affairs of the Village. To that end, he shall have power and shall be required to: A. Appoint and, when necessary for the good of the service, suspend • or remove the following department heads and all employees thereunder except as he may authorize the head of a department or office to appoint, suspend or remove subordinates in such department: Building Official, Director of Public Safety, D7aintenance Superintendent, Golf Professional, Golf Course Superinten- dent, Pool Manager, and such other heads of departments as may be established by the Village Council. B. Prepare the budget annually on or before July 31 and submit it to the Council together Leith a message describing the important features and be responsibe for its adminintration after adoption. C. Prepare and submit to the Council as of the end of the fiscal year a complete report on the finances and administrative activities of the Village for the preceding year. D. Keep the Council advised of the financial condition and future needs of the Village, and make such recommendations as he may deem desirable. E. Recommend to the governing body a standard schedule of pay for each appointive office and position in the Village service, including minimum, intermediate, and maximum rates together with vacation schedules and fringe • benefit factors. F. Recommend to the governing body (from time to time) adoption of such measures as he may deem necessary or expedient for the health, safety, or welfare of the community or for the improvement of administrative services. G. Consolidate or combine offices, positions, departments, and units under his jurisdiction as listed in Section 4. A, with the approval of the Council. The Village Manager may be the head of one or more departments. EIe shall furnish the Council with current organizational charts. n • H. Attend all meetings of the Village Council unless excused there- from and take part in the discussion of all matters coming before the Council. He, together with members of the Village Council, shall be entitled to notice ' of all regular and special meetings of the Council. The Village b7anager shall prepare the agenda for all Council meetings. I. Supervise the purchase of all materials, supplies, and equipment for which funds are provided in the budget; let contracts necessary for the operation or maintenance of Village services for amounts up to and including ' $500., receive bids for purchase> in excess of $500., and present bids for pur- chases in excess of $1f000. to the Council for approval, and advise the Council on the advantages or disadvantaga:s of bid proposals. No purchase shall be made, .i contract let or obligation incurred for any item or service which exceeds the • ~ current budget appropriation without a supplemental appropriation by the Council. No contract in excess of $1,000. and no contract for new construction shall be let except by the Village Council. The Manager may issue such rules governing purchasing procedures within the administrative organization as the Council shall approve. J. See that all laws and ordinances are duly enforced. K. Devote his entire time to the discharge of his official duties. ' L. Perform such other duties as may be required by the Council, ' not inconsistent with the Village Charter, law, or ordinances. Section 5. Council Not to Interfere with Appointments or Removals. Neither the Council nor any of.its members shall direct or request the ap- ' pointment of any person to, or h:is removal from, office by the Village Manager or any of his subordinates, or in any manner take part in the appointment or removal of officers and employees in the administrative services of the Village. Except for the purpose of inquiry, the Council and its members shall deal tiaith the administrative services solely through the Village Manager and neither the • Council nor any member thereof shall gibe orders to any subordinates of the Village Manager, either publicly or privately. Section 6. Bond. Tlie Village Manager shall furnish a surety bond to be approved by the Council, said bond to be conditioned on the faithful ' performance of his duties. The premium of the bond shall be paid by the Village. Section 7. Compensation. The Village Manager shall receive such compensation as the Council shall fix from time to time by ordinance or reso- lution. ' Section 8. Vacation. The annual vacation of the Village Manager shall be two (2) weeks per year. • Section 9. Saving Clause.. If any section, subsection, or sentence, clause, or phrase of this ordinance i s for any reason held invalid, such decision or decisions shall not affect the validity of the remaining ' portions of this duti s of h ad ordinance.
