2002-34 Charter Amendment - Notice of Special MeetingsORDINANCE 34-2002 L~ AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM B}?ACH, FLORIDA, SUBMITTING TO REFERENDUM A PROPOSED AMENDMENT TO TI IE VILI,AGIs CHARTF,R AMENDING SUBSECTION (a), MEETINGS, OF SECTION 9, PROCEDURE, OF ARTICLE III, LEGISLATIVE, TO PROVIDE THAT SPECIAL MEETINGS, WHENEVER PRACTICABLE, SHALL BE CALLED ON NO LESS THAN FORTY-EIGHT (48) }IOUKS' NOTICE TO EACH MEMBER AND TO THE PUBLIC; PROVIDING Tf-IA7' THIS ORDINANCE, UPON ADOPTION, SHALL BE SUBMITTED TO THE ELECTORS OF THF. VILLAGE OF NORTH PALM BEACH AT THE MARCH, 2003, ELECTION HELD WITHIN 7'HI; VILLAGE; PROVIDING FOR A NOTICE OF THE REFERENDUM ELECTION TO BE I'UBI,ISHED IN ACCORDANCE WITH THE STATE OF FLORIDA ELECTION CODES; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR AN EFFECTIVh DATI; OF THIS ORDINANCE; PROVIDING FOR INCLUSION IN THE VILLAGE CHARTER; AND PROVIDING FOR THE EFFECTIVE DATE OF PROPOSED CHARTER AMENDMENT. WIIERI'.AS, Chapter ]66, Florida Statutes, as amended, provides for charier amendments for municipalities and authorizes the governing body of a municipality, by ordinance, to submit to the electors of said municipality proposed amendments to its Charter; and WHEREAS, the Village Council is desirous of submitting the proposed amendment contained within this ordinance to a vote of the electors at the March, 2003, election to be held within the Village. BE 17' ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA: Section 1. That Subsection (a), Meetings, of Section 9, Procedure, of Article III, Legislative, of the Village Charter is hereby amended to read as follows: "ARTICLE III. LEGISLATIVE Section 9. Procedure. (a) Meetings. The council shall meet regularly at least once in every month at such • times and places as the council may prescribe by rule. Special meetings may be held on the call of the mayor or of a majority of the members and, whenever practicable, upon no less than forty-eight (48) hours' notice to each member and the public. (b) Rules and journal. The council shall determine its own rules and order • of business. (c) Voting. Voting, on ordinances and resolutions, shall be recorded in the journal. A majority of the council shall constitute a quorum; but a smaller number may adjourn from time to time and may compel the attendance of absent members in the manner and subject to the penalties prescribed by the rules of the council. No action of the council except as otherwise provided in the preceding sentence and in §5, shall be valid or binding unless adopted by the affirmative vote of the majority of a quorum present, and no ordinance or resolution shall be adopted unless by the affirmative vote of at least three (3) council members." Section 2. 'T'his ordinance, upon adoption, shall be submitted to the electors of the Village of North Palm Beach at the March, 2003, election. The ballot title and explanatory statement of the amendment shall be set forth as follows on the ballot for consideration by the qualified electors of the Village of North Palm Beach, Florida: "TITLE" Providing forty-eight (48) hours notice of special Council meetings to Council members and the public whenever practicable. "EXPLANATORY STATEMENT" The Village Charter prescribes twelve (12) hours notice to each Council member and the public of special meetings whenever practicable. This section would be amended to provide forty- eight (48) hours notice. Shall the above-described amendment be adopted? YES (FOR APPROVAL) NO (AGAINST APPROVAL) Section 3. The Village Clerk of the Village of North Palm Beach is authorized and directed to advertise the referendum election in accordance with the State of Florida Election Code. • 2 Section 4. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any • reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 5. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 6. This Ordinance shall take effect immediately upon adoption. Section 7. In the event of adoption by the electors as provided herein, the Village Clerk shall incorporate the amendment into the Village Charter and shall file the revised Charter with the Florida UeparUnent of State. Section 8. The proposed Charter amendments shall take effect upon adoption by a majority of electors voting in the referendum election. PLACED ON FIRST READING THIS 21st DAY OF NOVEMBER, 2002.
