BI? 1T ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Village Council of the Village ofNorih Palm Beach, Florida, does hereby create a Chapter 25 to the Code of Ordinances of the Village entitled "Swimming Pools" and to read as follows: "Chapter 25 Swimming Pools Section 25-1. Definitions As used in this chapter, the following words and phrases shall have the meaning indicated: I§iva/e /hernpeu/ic spa pool means any receptacle for water having a depth at any point greater than iwo (2) feet, used or intended to be used for bathing, and constructed, installed or maintained in or above ground as an accessory structure. A spa/pool shall have a surface area of less than sixty (60) square feet. I'rivnle swrniming pool. As defined in the Florida Building Code. Section 25-2 Setbacks. All Village zoning setback requirements shall be complied with in the plot location of any pool but in no event shall the setback of the outside rim of a private pool be less than seven and one half (7 1 /2) feet from the back property line and not less than five (5) feet from the side property line, including a two and one half (2 1/2) foot walk around the pool. Section 25-3 Permits. Applications for swimming pool permits shall be accompanied by payment of a fee in accordance with Village ordinances, and by plans and specifications prepared by a competent engineer registered in the State of Florida. Section 25-4. Construction. • Private and public pools shall be constructed of reinforced concrete, concrete block reinforced and poured after laying up, or of reinforced gunite construction. Section 25-5. Barrier/Fencing Requirements. • (a) A barrier, fence or screen enclosure shall surround a swimming pool as specified in the Residential Swimming Pool Enclosure section of the Florida Building Code. (h) The Building Official is required to conduct an inspection of all swimming pools not less than one time per year to determine compliance with this section and to enforce the provisions of this section. Section 2.5-6 Elevation. (a) 7'he top of the rim of all swimming pools shall not be in excess of two (2) feet above the average grade of the land surrounding the pool. (b) The top of the rim of any spa pool shall not be in excess of two (2) feet above the average grade of the land surrounding the pool or a permanent platform constructed completely around the rim of the spa pool. The maximum height of a spa pool above the grade of the land surrounding the pool shall he four (4) feet. Section 25-7. Final Approval. A final approval by the Building Official shall be issued prior to any use made of a swimming pool" Section 2. ]f any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a Couri to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 4. This Ordinance shall take effect immediately upon passage.
