131? 1T OKDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. Section 108.3, Powers, of the Florida Building Code, as adopted in Section 6-17,
Codes Adopted, Article 11, Minimum Construction Standards, of Chapter 6, Buildings and
1uilding Kegulations, of the Code of Ordinances of the Village of North Palm Beach, is hereby
amended to read as follows:
"108.3 Powers
The Construction Board of Adjustment and Appeals shall have the power, as further defined
in 108.4, to hear appeals of decisions and interpretations of the building official and consider
variances of the technical codes. The Board shall constitute the local contractor regulatory board
of Chapter 489 F.S. for hearings on the performance of state licensed, Certified contractors.
7'he same powers shall apply to the construction requirements only of the codes that apply to
bulkheads, docks, piers, dolphin poles, paving and drainage structures, signs, swimming pools
and housing.
The Construction Board of Adjustment and Appeals shall also serve as the Fire Code Board of
Appeals as outlined in Section 1-8, Board of Appeals, Chapter 1, Administration and
Enforcement, NFPA 1, Fire Prevention Code, as part of the Florida Fire Prevention Code."
Section 2. ]f any section, paragraph, sentence, clause, phrase or word of this Ordinance is for
any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not
affect the remainder of this Ordinance.
Section 3. All Ordinances or parts of Ordinances in conflict herein are hereby repealed
Section 4. "1"his Ordinance shall take effect upon passage.
