ORDINANCE # 50
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, PALM BEACH COiINTY, FLORIDA, PROHIBITING THE RECKLESS, CARE-
LESS OR NEGLIGENT OPERATION OF BOATS WITHIN SAID TOWN;DECLARING CERTAIN
SPEEDS WITHIN DESIGNATED AREAS TO BE INLAWFUL AND PRIMA FACIE EVIDENCE
OF RECKLESSNESS; REGULATING SWIMMING WITHIN CERTAIN AREAS; PROVIDING
PENALTIES FOR VIOLATION; AND FOR OTHER PURPOSES.

BE IT-ORDAINED BY THE VILLAGE COUNCIL. OF THE VILLAGE OF NORTH
PALM BEACH, as follows:-
Section 1. It shall be unlawful for any person to operate any
.
boat or other water-craft, recklessly, carelessly or negligently upon,
over or in any waters, body of water, lake, canal or lagoon within the_
corporate linits of the Village in such manner so as to endanger persons
or property.
Section 2. It shall be unlawful for any person to operate any
boat or other water-craft over or in any waters, lake, canal or lagoon_
within the corporate limits of the Village in such manner that the wake
left or created by such vessel shall threaten the destruction of property,
' or endanger ar imperil the lives or safety of persons.
Section 3. It shall be unlawful to operate any boat or other
water-craft at a speed in excess of five (5) miles per hour over or upon
any waters lying within one thousand (1,000) feet of the intersection of
the Earman River, the North Palm Beach Waterway, and the operation of any
boat or other water-craft within such restricted .area at a speed in excess
of that hereinabove prescribed shall be deemed prima facie evidence of
recklessness and a violation of this Ordinance.
Section 4. It shall be unlawful for any person to engage in swim-
ming in the restricted waters referred to in Section 3 above.
Section 5. No muffler o~ other sound or noise reducing equipment
shall be removed or omitted from any motor or engine used to propel boats
or other water-craft within the Village limits; likewise all "cut-outs"
' are hereby prohibited.
Section b. Any person convicted of violating this Ordinance shall
be punished by a fine not to exceed Five Hundred and No/100 Dollars ($500.00)
or imprisonment not to exceed Sixty (60) days or by both such fine and im-
prisonment.
Section 7. This Ordinance shall take effect upon its passage and
approval according to law.
