' AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH
COUNTY, FLORIDA, REQUIRING THE POSTING OF A BOND ~Y CERTAIN CON-
TRACTORS TO INSURE THE REMOVAL OF POST CONSTRUCTION DEBRIS FROM
BUILDING SITES; PROVIDING FOR THE REPEAL OA ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR AN EFFECTIVE DATE HEREOF AND FOA OTHER

BE IT ORDAINED B1' THE lTILLAGE COUNCIL OF THE VILLAGE OF NORTH
• PALM BEACH, FLORIDA, as follows:
Section 1. Definitionsc. For the purposes of this ordinance
the following term shall have the meaning herein:
(a) Contractor: A contractor is any person or firm who under-
takes, or offers to undertake, or purports to have the capacity
to undertake or submits a bid or does himself or by or through
others, to construct, alter, repair, add to, subtract from,
improve, move, wreck, to demolish any building, or other
' structure, to excavate, to prefabricate any building or portion
of a building, commence any project, development or improvement
or do any part thereof including the erection of scaffolding, or
any other structures or works in connection with or the incor-
poration of labor or materials therein or thereon.
Section 2. Suretv Bond_ Prior to issuance of any building permit
to a contractor by the Building Official, the contractor on applying for
such permit shall deposit with the Village Clerk a surety bond in the
• amount of $500.00 payable to the Village of North Palm Beach, Florida.
The required surety bond must be:
(a) With a good and sufficient surety;
(b) By a surety company authorized to transact business
' within the state;
(c) Satisfactory to the Village Attorney in form and
substance;
(d) Conditioned upon the contractor's compliance with
the provisions of this ordinance, and further conditioned upon the
contractor removing and cleaning from all building sites upon which
he may perform work, all debris, rubbish, building materials, or-
other construction residue, such cleaning or clearing to be performed
• in such manner that the premises shall hereafter meet the approval
of the Village Building Official and the requirements f'4x'issuance

of a certificate of occupancy.
Section 3. Number of Bonds Required. Upon the posting of a
surety bond in compliance with Section 2 of this ordinance, no contractor
' shall be required to post a similar bond as a prerequisite to the issuance
of subsequent or additional building permits, so long as the issuance of
such additional permits falls within the period during which said bond
is in force and effect.

issued to any contractor subsequent to the expiration date of a surety
bond so deposited in accordance with the foregoing sections unless
satisfactory proof is present;ed to the Town Clerk evidencing renewal of

said bond, or unless the contractor posts a new bond.
Section 5. Cash Bond_ In lieu of posting a surety bond as
provided under Section 2-5 ak~ove, any contractor may elect to place a
cash deposit with the Village Clerk in the amount of $75.00 for each
building permit for which application is made, said deposit to serve as
security for LhP"performance of the conditions of an accompanying bond
to be executed by the contractor, said bond being conditioned in the
same manner as provided for :>urety bonds under Sections 2 (a) and (b)
above.
Section 6. Refund of Cash Deposit. Upon the cessation of
business activity within the Village, any contractor posting a cash
bond as provided under Section 5 above, may make application to the
Village Clerk for refund of the cash deposit so standing to his credit.
The Village Clerk shall thereafter, upon notification by the Village
Building Official that all work performed by said contractor has been
completed in accordance with the conditions of his bond and the pro-
visions of this ordinance, refund to the contractor the full amount

of such cash deposit.
Section 7. All Ordinances or parts of ordinances in conflict
herewith are hereby repealed.
' Section 8. This ordinance shall take effect upon its passage
and approval as provided by ].aw.
