Ordinance 041 Model Traffic Ord. for Municipalities Page ORDINANCE N0. 41 ~_ AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH COUNTY,FLORIDA, ADOPTING, WITH CERTAIN EXCEPTIONS, THE PROVISIONS OF CHAPTER 186, FLA. STATUTES 1957, ENTITLED "MODEL TRAFFIC ORDINANCE FOA MUNICIPALITIES"; PROVIDING PENALTIES FOR VIOLATION OF THE PRO- VISIONS THEREOF; REPEALING ORDINANCES IN CON- FLICT THEREWITH; FOR OTHER PURPOSES. WHEREAS, Section 165.191, FIa. Statutes 1957, empowers i municipal bodies to adopt or incorporate into an ordinance by refer- ence the previsions of any code or public record; and WHEREAS, Section 186.02 Fla. Statutes 1957, specifically authorizes a municipality, through enactment of an appropriate ordinance, to adopt by reference the Florida Model Traffic Ordinance, comprising Chapter 186 of said Fla. Statutes 1957; and WHEREAS, the Village Council has deemed.it essential and in the best interests of the .public safety and welfare to adopt a comprehensive traffic code fdr the uniform regulation of vehicular traffic upon the streets and thoroughfares of the Village, NOW THEREFORE, by virtue of the authority vested in the Village Council pursuant to the statutory provisions set forth above, BE IT ORDAINED BY THE VILLAGE COUNCIL OF 7HE VILLAGE OF n NORTH PALM BEACH, FLORIDA: Section 1. That the Florida Model Traffic Ordinance, set forth as Chapter 186, Fla. Statutes 1957, be and the same is hereby adopted in its entirety as the traffic code in and for the Village of North Palm Beach, Florida, subject to the omitted provisions set forth under section 2 below, and that the provisions of this chapter shall henceforth be carried into effect and enforced in the manner therein prescribed as the traffic code for said Village. Section 2_ That Sections 186.12, 186.39 and 186.0194 are J specifically omitted from the operation of this adopting ordinance and shall in nowise be considered a part of the- traffic code of said Village. n ~i Page Section 3, That all ordinances or parts of ordinances in conflict herewith are hereby repealed. __ Section 4.That whosoever shall violate the provisions of this section, upon conviction thereof, shall be punished by fine not exceeding $500 or by imprisonment not to exceed 90 days, or by both such fine or imprisonment in the discretion of the Village Court. Section 5. That this ordinance shall take effect upon its passage and approval according to law. PASSED AND ADOPTED on first reading this 23rd day of December 1958.
