ORDINANCE # 40
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH
COUNTY, FLORIDA, AMENDING ORDINANCE N0. 20, THE SAME BEING THE COMPREHENSIVE
ZONING ORDINANCE OF THE VILLAGE, BY REMOVING CERTAIN PROk~ERTY FROM ZONING
CLASSIFICATION "R-1", SINGLE FAMILY DWELLING DISTRICT, AND RECLASSIFYING
' SAID PROPERTY AS "R-3", APARTMENT DWELLING DISTRICT; BY DIRECTING THE VILLAGE
MANAGER TO APPROPRIATELY REFLECT SUCH RECLASSIFICATION UPON 7HE OFFICIAL
ZONING MAP; AND FOR OTHER PURPOSES.

• WHEREAS, the Village Council, pursuant to authority vested in it
under Section 14, of Ordinance No. 20, the same being the comprehensive
zoning ordinance of said Village, has deemed it desirable, necessary and to
the best interest of the public welfare to reclassify certain property within
the Village with respect to zoning or use classification; and
WHEREAS, public hearings relative to said proposed zoning changes
were duly held following publication o£-the date and purpose of said hearings
as prescribed by law, now therefore
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
' PALM BEACH, PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. That Ordinance entitled "A COMPREHENSIVE ORDINANCE
REGULATING THE USES OF LAND, WATER, BUILDINGS AND STRUCTURES WITHIN THE
VILLAGE OF NORTH PALM BEACH, FLORIDA, FOR TRADE, INDUSTRY, RESIDENCE OR
OTHER PURPOSES: REGULATING THE LOCATION, HEIGHT, SIZE OF BUILDINGS AND
STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, THE DENSITY AND DIS-
TRIBUTION OF POPULATION AND FOR SAID PURPOSES, CREATING SIX (6) DISTRICTS
AND ESTABLISHING THE BOUNDARIES THEREOF AND ADOPTING A MAP OF SAID DISTRICTS:
• DEFINING CERTAIN TERMS USED: ESTABLISHING A BOARD OF ADJUSTMENT AND PROVIDING
FOR THE ENFORCEMENT AND AMENDMENT THEREOF AND PRESCRIBING PENALTIES FOR THE
VIOLATION OF ITS PROVISIONS." and the same is hereby amended in the following
respects, to-wit:
' (a) The following described parcels o£ property are hereby
removed from zoning classification "R-1", Single .Family Dwelling District,
to-wit:
Parcel No. 1 - A strip of land lying to either side
' of the right-of-way of State Road #703, as presently
laid out and in use:; 125 feet in depth as measured at
right angles to the respective right-of-way lines of
said State Road #703, bounded on the North by the
Northern territorial limits of said Village of North
Palm Beach and on the South by the second most Easterly
bulkhead line as depicted on Bulkhead Map #2 attached

to Ordinance #31 of said Village.
' Parcel No. 2 - That- portion of MacArthur Island lying
North of the a ccess road all as depicted on the Official =._
Zoning Map of the Village of North Palm Beach on file
in the office of the Village Manager.
' The above described
as "R-3"
Apartment parcels
Dwelling of property shall henceforth be zoned and classified
District.

Section 2. That t he Village Clerk is hereby authorized and
directed to reflect upon the Official Zoning Map, by hatching or other

appropriate means of designa tion, the changes in zoning classification
effected under this amending ordinance.
Section 3. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4. That this ordinance shall take effect upon its
passage and approval as provided by law.
PASSED AND ADOPTED on first reading this 9th day of
December, 1958.
PASSED AND ADOPTED on second and final reading this 23rd day
of December 1958.
