AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, RELATING TO THE ELIMINATION OF THE DEPARTMENT OF
PUBLIC SERVICES AND THE CREATION OF A DEPARTMENT OF PUBLIC WORKS
AND A DEPARTMENT OF COMMUNITY DEVELOPMENT; AMENDING CHAPTER 2,
"ADMINISTRATION," ARTICLE III, "ADMINISTRATIVE CODE," OF THE VILLAGE
CODE OF ORDINANCES BY AMENDING DIVISION 6, "DEPARTMENT OF PUBLIC
SERVICES," AND CREATING A NEW DIVISION 10, "DEPARTMENT OF COMMUNITY
DEVELOPMENT;" AMENDING SECTION 2-84 AND SECTION 2-85 AND CREATING A
NEW SECTION 2-111 AND 2-112; PROVIDING FOR CODIFICATION; PROVIDING FOR
SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Village Administration has recommended dividing the Village's existing Public
Services Department into two separate new departments to be called the Department of Public
Works and the Department of Community Development; and
WHEREAS, Village Council seeks to implement the Administration's recommendations and
amend the Village Code of Ordinances to eliminate the reference to the Public Services
Department and create and define the duties and divisions of the newly created Department of
Public Works and Department of Community Development; and
WHEREAS, the Village Council determines that the enactment of this ordinance is in the best
interests of the public health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein.
Section 2. The Village Council hereby amends Chapter 2, "Administration," Article III,
"Administrative Code," Division 6, "Department of Public Services," of the Village Code of
Ordinances to read as follows (new language is underlined and deleted language is st~l~

Sec. 2-84. Director's duties.

relating to construction, management, maintenance and operation of the physical
properties of the village.
Sec.2-85. Divisions.

Section 3. The Village Council hereby amends Chapter 2, "Administration," Article III,
"Administrative Code," by creating a new Division 10, "Department of Community
Development," to read as follows (new language is underlined):
DIVISION 10. DEPARTMENT OF COMMUNITY DEVELOPMENT
Sec. 2-111. Director's duties.
The director of community development shall be responsible for all
matters relating to planning and zoning building permitting and inspection and
code compliance.
Sec.2-112. Divisions.
The department of community development shall be divided into the
following divisions:
Division of permits and inspections, which shall: L, working in
coordination with the village engineer, issue all hermits for, and
inspect the work involved in, the construction of sidewalks, curb
cuts, street cuts; (2) inspect all work performed under the
provisions of the electrical, plumbing and building codes of the
village; and (3 inspect all premises including structures and
appurtenances thereon, for safety features.
Code compliance division which shall inspect encourage enforce
monitor and report on compliance with the village's code of
ordinances on all properties throughout the village.
Planning division, which shall assist the director in modifvin~ and
updating the village's land development regulations and zoning
code• review development plans for zoning- compliance and
development issues; interpret state codes' review and provide the
director with guidance on village comRliance with the
comprehensive plan; and assist village administration with
annexation and development or redevelopment plannin cg oncepts
zonin overlays and other such development matters.
Section 4. The provisions of this Ordinance shall become and be made a part of the Code of
the Village of North Palm Beach.
Section 5. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for
any reason held by a court of competent jurisdiction to be unconstitutional, inoperative or void,
such holding shall not affect the remainder of this Ordinance.
Section 6. All Ordinances or parts of Ordinances or resolutions or parts of resolutions in
conflict herewith are hereby repealed to the extent of such conflict.
Section 7. This Ordinance shall take effect immediately upon adoption.
