AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA, AMENDING ARTICLE I, "IN
GENERAL," OF APPENDIX C, "ZONING," OF THE VILLAGE CODE
OF ORDINANCES TO ADD A NEW SECTION 45-23, "EMERGENCY
GENERATORS REQUIRED FOR AUTOMOTIVE SERVICE
STATIONS;" REQUIRING PERMANENT GENERATORS FOR
NEWLY CONSTRUCTED AND RECONSTRUCTED STATIONS;
PROVIDING FOR INSTALLATION OF A TRANSFER SWITCH FOR
EXISTING STATIONS; PROVIDING FOR CODIFICATION;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in order to provide essential services to its residents following a hurricane or
other natural disaster resulting in an extended power outage, the Village Council seeks to
require that all newly constructed and reconstructed automotive service stations in the
Village install emergency generators and that all existing automotive service stations in
the Village install an electrical transfer switch to allow for use of a portable generator;
and
WHEREAS, the Village Council determines that the enactment of this ordinance is in the
interests of the public health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and correct and are incorporated
herein.
Section 2. The Village Council hereby amends Article I, "In General," of Appendix
C, "Zoning," of the Village Code of Ordinances by creating a new Section 45-23,
"Emergency Generators Required for Automotive Service Stations," to read as follows:
Sec. 45-23. EmerEency Generators Required for Automotive Service
Stations.
All newly constructed automotive service stations shall have a
permanently installed emergency generator. Existing automotive service
stations shall be required to install permanent emergencygenerators
whenever such service station is rebuilt after bein dg_estroyed to an extent
of more than fifty (50) percent of its assessed value or whenever a revised
site plan for such service station is submitted for approval which enlarges
upon or alters in any way the original site plan for that service station. All
others shall have a transfer switch installed within two (2Lyears of the
passage of this Ordinance, to allow for a portable generator to be easily
connected to the service station. For the purposes of this section an
automotive service station means any commercial establishment engaged
in the retail sale of gasoline.
Section 3. The provisions of this Ordinance shall become and be made a part of the
Zoning Code of the Village of North Palm Beach. The sections of this Ordinance may be
renumbered or relettered to accomplish such, and the word "ordinance" may be changed
to "section," "article" or any other appropriate word.
Section 4. If any section, paragraph, sentence, clause, phrase or word of this
Ordinance is for any reason held by a court of competent jurisdiction to be
unconstitutional, inoperative or void, such holding shall not affect the remainder of this
Ordinance.
Section 5. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
Section 6. This Ordinance shall take effect October 1, 2006.
