AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING SECTION 5-33, DESIGNATED; USE RESTRICTED AND
SECTION 5-35, PERMITS REQUIRED, OF ARTICLE II, BOAT LAUNCHING AREA, OF
CHAPTER 5, BOATS, DOCKS AND WATERWAYS, OF THE CODE OF ORDINANCES OF
THE VILLAGE; ADDING SECTION 5-38 TITLED VIOLATION; PENALTY; PROVIDING
FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. Section 5-33, Designated; Use Restricted of Article II, Boat Launching Area, of
Chapter 5, Boats, Docks and Waterways, of the Code of Ordinances of the Village is hereby
amended to read as follows:
"Section 5-33. Designated; use restricted.
No person shall bring into, launch or operate any vessel (as defined in Florida Statutes
Section 327.02) upon any park property, including designated swimming areas, except as
such places as are or may be designated for such use or purposes by the North Palm
Beach Village Council. Such operation or use shall be in accordance with such rules and
regulations as are now or may hereafter be adopted by the Village Council. All vehicles
using the boat ramps of Anchorage Park or parking with a trailer at Anchorage Park must
have a Village launch ramp sticker permanently affixed to the vehicle, visible from
behind the vehicle."
Section 2. Section 5-35, Permits Required, of Article II, Boat Launching Area, of Chapter 5,
Boats, Docks and Waterways, of the Code of Ordinances of the Village is hereby re-titled and
amended to read as follows:
"Section 5-35. Vehicle/trailer parking in designated areas (Permits required).
(a) No person shall park a vehicle on park property at any place other than in the
regularly designated facilities provided for that particular type of vehicle unless otherwise
directed by a law enforcement officer or Village employee or by official signs or
markings.
(b) No boats or boat trailers shall be allowed to remain more than twenty-four (24) hours
at the Village boat launching area unless a written permit therefore has been secured from
the Village Manager or his designee. Such permits shall be issued upon such reasonable
regulations and upon such cost as shall be determined, from time to time, by the
Village Council."
Section 3. Section 5-38 titled Violation; Penalty of Article II, Boat Launching Area, of
Chapter 5, Boats, Docks and Waterways, is hereby added to the Code of Ordinances of the
Village and to read as follows:
"Section 5-38. Violation; Penalty.
Violation of any provision of Section 5-33, Designated; Use Restricted or Section 5-35,
Vehicle/Trailer parking in Designated Areas (permits required) shall result in a civil fine
of $50.00 for a first offense and $100.00 for any subsequent violation."
Section 4. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for
any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not
affect the remainder of this Ordinance.
Section 5. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
Section 6. This Ordinance shall take effect immediately upon passage.
