THE USE OF POWER DRIVEN MACHINERY, TOOLS OR EQUIPMENT' DURING SAID HOURS

THE INHABITANTS IN SAID RESIDENTIAL DISTRICT OR SECTION; PROVIDING PENALTY
FOR TIC VIOLATION HEREOF; REPERLING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH.

BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA:
Section 1. No person, firm or corporation shall cause or permit

the erection, demolition, alteration or repair of any building in any
portion of the Village zoned and designated as a residential district or
section, other than between the hours of 8:00 A, M, and 8:00 P. M, on week- _-
days, and between the hours of 12:00 Noon and 6:00 P. M, on Sundays.
Section 2, No person, firm or corporation shall cause or permit
the use of anp power driven machinery, tools or equilxnent in any portion of
the Village zoned and designated as a residential district or section other
than between the hours of 8:00 A. M, and "0:00 P. M, on weekdays and between
the hours of 12:00 Noon and 6:00 P, M. on Sundays. Power mowers shall be used
only between the hours of 8:00 A. 24. and f3:00 P. M, weekdays, and on Sundays
only between the hours of 12:00 Noon and 6:00 P.M.
Section 3. No person shall keep any animal or fowl which shall
disturb the comfort or rest of any person in the vicinity, with frequent or
long continued noises of any kind whatsoever, including the barking, howling,
yelping or crowing of any animal or fowl, in any portion of the Village zoned
and designated as a residential district or section.
Section 4. Provided, hocaever, that if application is made to per-

form such work before 8:00 A, M. or after 6:OD P. M., the Village Manager shall
determine whether said work is of urgent necessity or in the interest of public
health and safety, and if he should so determine, and if he should further
determine that the public health and safety would not be impaired by said work,

within the hours of 6:00 P. M. and 5:00 A. M., and if he should further
determine that loss or great inconvenience would result to any party in
interest, he may grant permission for such work to be done within the
hours of &:DO P. M. and 5:00 A. M., such permit may be granted fora period
of one (1) week unless a longer time is authorized by the Village Council.
Section S. Any person, firm or corporation, violating any of the
provisions of this Ordinance shall upon conviction thereof be punished by
a fine of not more than $500.00 or by imprisonment of not more than sixty
(60) days, or by both such fine and imprisonment.
Section 6. All Ordinances or parts of Ordinances in conflict
herewith be, and the same hereby are repealed.
This Ordinance shall take effect immediately upon its passage
as provided by law.
