Ordinance 016 BulkheadPage ORDINANCE #16 1 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REGULATING 7'i-IE BUILDING UP OF LAND UPON THE SUBb1ERGED BOTTOMS IN LAKE WORTH AND THE TIDAL WATERS WITHIN THE TERRITORIAL LI?~IITS OF SAID VILLAGE; PROVIDING FOR THE ESTABLISHMENT OF BULKHEAD LINES WITHIN SUCH WATERS; REGULATING DREDGING AND FILLING OPERATIONS WITH RESPECT TO SAID BULKHEAD LINES; PROHIBITING THE ERECTION OF CERTAIN STRiJCTURES BEYOND SAID BULKHEAD LINES; PROVIDING FOR THE SUBMISSION OF APPLICATIONS F>RIOR TO THE COMMENCEMENT OF FILLING OR DREDGING OPERA- TIONS AND FOR THE FEES TO BE PAID IN CONNECTION THEREWITH; PROVIDING FOR THE ENFORCEMENT OF THE PROVISIONS OF THIS ORDINANCE AND FOR PENALTIES FOR VIOLATIONS THEREOF. * ~ BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AS FOLLOWS: Section 1. That there be, and there is hereby established, a comprehensive system of bulkhead lines in the waters of Lake Worth and the tidal waters within the territorial limits of the Village of North Palm Beach, Florida, which said bulkhead lines shall be along the lines indicated and shown in red on the maps attached hereto, made a part hereof, and which are marked respectively, Bulkhead Maps 1 and 2. Section 2. That hereafter, no fill shall be made, deposited or maintained in the waters of Lake Worth lying within the Village of North Palm Beach limits, waterward or outward from any shoreline, in such a manner so that such fill shall extend beyond any bulkhead line as established and designated on the bulkhead maps referred to in Section 1 above. Section 3. No person, firm or corporation may make or deposit i any fill in the waters of Lake Worth within the limits of the Village of North Palm Beach prior to receiving a permit therefor from the Village Council of the Village of North Palm Beach. All persons, firms or corporations desiring to make such fill shall first submit a written application to the Clerk of said Village re- questing the issuance of a permit and such application shall be accompanied by a surveyors sketch of what is proposed to be done, the proposed area to be filled, the area to be dredged for procuring fill r.±aterial, aad such other information and data as may be pertinent to the proposed filling. Prior to the issuance of r1 U Page ,SO i any permit, the Village Council may require such modification or change of specifications as may be deemed necessary to meet the purposes of this ordinance. Each application submitted to the Village Clerk shall be ac- companied by a fee of $10., and such fee shall be payable whether or not the permit therefor be granted or approved. If such permit is granted, the fill shall be made in accord- n U ance with the plans and specifications designated in the application. Any change in such plans or specifications subsequent to the issuance of a permit shall be the subject of a new or supplemental application, and a like fee shall be paid upon the filing of such application as was paid in the case of the. original application. Pdo permit shall be issued for a period within which the proposed work is to be completed longer than 2 years from the date of its issuance. The renewal of any permit prior to sixty (60) days after its expiration date may be granted. For violation of or non-compliance with its terms, any such permit issued may be revoked after notice of intention so to do has been communicated to the holder an3 opportunity afforded within a reasonable time for a hearing thereon. Section 4. P1o person, firm or corporation may make or place any fill in the waters of Lake Worth until appropriate permission therefor shall also be given by the Corps of Engineers of the United States Army. Section S. Any fill which shall be made contrary to this ordinance shall be unlawful, and the same shall be removed upon order of the Village Council. Section 6. '.Chat hereafter, no building may be constructed, erected or maintained beyond said bulkhead lines, except wharves or docks. Section 7. Any person, firm or corporation who violates this Ordinance shall, upon convi<:tion, be fined not to-exceed Five Hundred Dollars 0500.00). Section 8. Each day any such unlawful fill shall continue to exist shall be a separate offense. Section 9. This Ordinance shall take effect as provided by law. FIRST READING the 13 day of May, 1957.
