1999-043 Seawall Anchor Easement to WCI• • SOLUTION NO. 43 -99 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO EXECUTE AND DELIVER TO WCI COMMUNITIES, INC. THE GRANT OF EASEMENT ATTACHED AS EXHIBIT "A ", WHICH GRANT IS FOR A PERPETUAL NON - EXCLUSIVE SEAWALL ANCHOR EASEMENT WITHIN THE VILLAGE; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby approve the grant of easement to WCI Communities, Inc. attached as Exhibit "A ", which grant is of a perpetual non - exclusive seawall anchor easement within the Village. Section 2. The Mayor and Village Clerk are hereby authorized and directed to execute and deliver the grant of easement set forth in Exhibit "A" for and on behalf of the Village of North Palm Beach. GRANTEE by acceptance of this EASEMENT agrees for itself, its successors and assigns, to maintain said EASEMENT and in no way interfere, at any time, with the right of ingress or egress of GRANTOR, its successors and assigns, or any other party requiring access to any of the aforesaid property and further to restore and landscape the surface of aforesaid property following installation or repair of seawall and/or bulkhead anchoring and tie -back devices. SUBJECT TO easements, restrictions, covenants, conditions, limitations and reservations of record, if any. THIS EASEMENT and Covenants contained herein, including all benefits and burdens, are not personal, but shall rule with the land and shall be binding upon and inure to the benefit of the parties hereto and their transferees, successors and assigns.
