A RESOLUTION OF THE VILLAGE COUNCIL OF THE VII,LAGE OF NORTH
PALM BEACH, FLORIDA, SPECIFYING ITS INTENT TO INCLUDE CERTAIN
ITEMS IN ITS EVALUATION AND APPRAISAL REPORT (EAR) BASED
COMPREHENSIVE PLAN AMENDMENTS TO ADDRESS THE FLORIDA
DEPARTMENT OF COMMUNITY AFFAIRS OBJECTIONS RAISED IN ITS
OBJECTIONS, RECOMMENDATIONS AND COMMENTS REPORT (ORC
REPORT) DATED OCTOBER 14, 1998; AND, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS,- the Florida Department of Community Affairs, in its Objections,
Recommendations and Comments Report (ORC Report) dated October 14, 1998, raised an objection
regarding the Village of North Palm Beach proposed Comprehensive Plan Amendment 98-1 (DCA
No. 98-1A); and
• WHEREAS, the Village of North Palm Beach is currently involved in the preparation of its
Evaluation and Appraisal Report (EAR) based Comprehensive Plan Amendments, with an anticipated
submittal date to the Department of Community Affairs of April 1, 1999; and
WHEREAS, the Village of North Palm Beach and the Florida Department of Community
Affairs mutually agree that the Village can comprehensively address the ORC Report objection during
the preparation of its EAR based Comprehensive Plan Amendments.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, FLORIDA:
~cliQO 1 The Village Council of North Palm Beach, Florida, does hereby specify its intent
to include the following items in its EAR based Comprehensive Plan Amendments to address the
• Florida Department of Community Affairs objections raised in its ORC Report dated October 14,
] 998:
• (1) Policy 2.2 of the Future Land Use Element shall be revised to indicate that the
Village has adopted the countywide wellfield protection ordinance. Further, existing
policies within the Comprehensive Plan shall be combined under a single objective and
represent the Village's wellfield protection program.
(2) 'The Village shall adopt the Future Land Use Map Series to reflect the current
location of wellfield protection zones within the corporate limits of North Palm
Beach.
(3) The Village shall incorporate objectives and policies within the Comprehensive
Plan to provide for the protection of water wells and/or wellfield zones/areas, as
required bylaw. Specifically, objectives and policies shall be included in the Village
Comprehensive Plan to address the following law. Florida Statutes, Chapter
• 163.3177(9)(g) and Florida Administrative Code, Chapters 9J-5.005(6), 9J-
5.006(1)(b)1,9J-5006(4)(b)1, 9J-5-006(3)(b)4 and 9J-5013(2)(c)l.
Section 2. This Resolution shall take effect immediately upon its adoption.
