SOLUTION NO. 39-99
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, FLORIDA, APPROVING A MINOR MODIFICATION TO THE
PLANNED UNIT DEVELOPMENT KNOWN AS "PROSPERITY HARBOR
SOUTH" CREATED BY ORDINANCE N0.26-96 BY MODIFYING SECTION
6 THEREOF TO ALLOW ISSUANCE OF BUILDING PERMITS FOR TWO (2)
MODEL HOMES PRIOR TO APPROVAL OF THE PLAT FOR THE PROJECT;
PROVIDING FOR THE REPEAL OF ALL RESOLUTIONS OR PARTS OF
RESOLUTIONS 1N CONFLICT HEREWITH; AND, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Village Council of the Village of North Palm Beach, Florida, enacted
Ordinance No. 26-96 which created a planned unit development known as "Prosperity Harbor
South"; and,
WHEREAS, Section 14 of Ordinance No. 26-96 provides that modifications to the planned
unit development determined to be minor by the Village Council may be approved by subsequent
resolution without the necessity of review by the Planning Commission, advertisement, or public
hearing; and
WHEREAS, the Village Council has determined that the modification set forth herein is minor
in nature.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
• FLORIDA:
Section 1. The Village Council ofthe Village of North Palm Beach, Florida, does hereby
modify Section 6 of Ordinance No. 26-96 of the Village to allow issuance of building permits for two
(2) model homes prior to approval of the plat for the project. Certificates of occupancy shall not be
issued for the model homes until such time as a plat has been approved by the Village Council and
all other conditions precedent set forth in Ordinance No. 26-96 and the Code of Ordinances have
been complied with.
Section 2. The Village Council does hereby detemtine that the modification to the planned
unit development is minor in nature and does not necessitate review by the Planning Commission,
advertisement or public hearing.
Section 3• All resolutions or parts ofresolutions in conflict herewith are hereby repealed.
Section 4. This resolution shall take effect immediately upon its adoption.
