1999-021 Opposes SB 1370 re: Solid Waste Management• RESOLUTION NO. 21-9s A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, IN STRONG OPPOSITION TO SENATE BILL 1370 WHICH ESTABLISHES NEW AND UNWARRANTED LIABILITIES AND RESTRICTIONS UPON LOCAL GOVERNMENTS THAT PROVIDE SOLID WASTE MANAGEMENT SERVICES FOR ITS CITIZENS; AND, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Senate Bill 1370 would effectively repeal the provisions of Chapter 542 of the Florida Statutes known as the Florida Anti-Trust Act which prohibits civil and criminal law suits against local governments and its employees and officials and would expose • local governments and their elected officials and employees to criminal prosecution, treble damages, civil penalties and other costs of litigation; and WHEREAS, Senate Bill 1370 requires local governments to separately account for their revenues and expenses associated with their solid waste management services which will increase a local government's costs for accounting services with no apparent public benefit; and WHEREAS, Senate Bill 1370 would severely restrict the right of a local government to provide the most cost effective solid waste management services for its citizens to the exclusion of private companies without fear of private companies securing damages as displaced competition. • BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: • i n 1 The Village Council of the Village of North Palm Beach, Florida, does hereby express its strong opposition to Senate Bill 1370 which establishes new and unwarranted liabilities and restrictions for local governments that provide solid waste management services for its citizens. ion The Village Clerk shall furnish certified copies of this resolution to members of the local Legislative delegation and such other persons and entities as the Mayor directs. e 'on This resolution shall take effect immediately upon its adoption.
