A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA, RECOMMENDING COUNTY-WIDE REGULATION
OF ADULT ENTERTAINMENT ESTABLISHMENTS.
WHEREAS, the Village of North Palm Beach has the home rule powers granted
unto municipalities by the Constitution of the State of Florida; and
WHEREAS, the Village of North Palm Beach, pursuant to the Constitution and laws
of the State of Florida, has the authority to exercise all powers for municipal government
purposes; and
WHEREAS, the Village of North Palm Beach is charged with the responsibility of
protecting the health, safety and general welfare of its citizens; and
WHEREAS, the Village of North Palm Beach has enacted land development
• regulations to regulate adult entertainment establishments located within the Village of
North Palm Beach; and
WHEREAS, the adult entertainment regulations enacted are intended to provide
opportunities for the expression of individuals' first amendment rights of freedom of
expression; and
WHEREAS, the Village of North Palm Beach and other local governments have
compelling state interest in regulating adult entertainment establishments to protect the
citizens of North Palm Beach and the County from the negative secondary effects of adult
entertainment establishments; and
WHEREAS, there is a proliferation of adult entertainment establishments in Palm
Beach County; and
WHEREAS, the Village Council of the Village of North Palm Beach believes the
most effective regulation of existing and future adult entertainment establishments in Palm
• Beach County must involve the cooperation of municipal, county and state governmental
entities, and state and local law enforcement agencies.

NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF NORTH PALM BEACH, FLORIDA;
Section 1. In order to further the compelling state interest of protecting the citizens
of the Village of North Palm Beach and Palm Beach County from the adverse secondary
effects of adult entertainment establishments, the Village Council of North Palm Beach
recommends the creation of a task force consisting of legal and administrative officials
from municipalities, Palm Beach County, the Palm Beach County Sheriff's Office, State
of Florida Division of Alcohol, Beverages and Tobacco, and the Office of the State
Attorney of the Fifteenth Judicial Circuit.
Section 2. The purpose of the above-referenced task force would be to evaluate
existing regulations which pertain to the regulation of adult entertainment establishments
and to recommend ways to strengthen the regulation of adult entertainment establishments
so as to further the compelling state interest of protecting the public from the adverse
secondary effects of adult entertainment establishments.
Section 3. The Village Clerk is hereby directed to transmit copies of this resolution
to the Municipal League of Palm Beach County, the Palm Beach County Board of County
Commissioners, Sheriff Robert E. Neumann, State Attorney Barry Krischer, the State
Division of Alcohol, Beverages and Tobacco, and all Palm Beach County municipalities.
Section 4. This Resolution shall take effect immediately upon adoption.
