1998-053 Disapproving Adelphia Cable TV Increase RESOLUTION NO. 53-98 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, DISAPPROVING THE PROPOSED INCREASE BY ADELPHIA CABLE COMMUNICATIONS IN ITS CABLE PROGRAMJv1ING SERVICE TIER RATE BY TWO DOLLARS AND EIGHTEEN CENTS ($2.18); AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO EXECUTE AND FILE FCC FORM 329, CABLE PROGRAMMING SERVICES RATE COMPLAINT FORM, WITH THE FEDERAL COMMUNICATIONS COMMISSION; AND, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Adelphia Cable Communications proposes rate changes inclusive of an • uicrease of two dolla~~s and eighteen cents ($2.18) in its cable programming service tier rate; and WHEREAS, the Mayor and Village Council have instructed the Village staff to evaluate the proposal in a manner consistent with FCC Cable Television Rate Regulation Standards; and WHEREAS, Village staff has evaluated the proposal by Adelphia Cable Communications and placed its report before the Village Council at a duly noticed public hearing; and WHEREAS, the Village Council has received and evaluated subscriber complaints together with the report of Village staff and finds that the proposed increase of two dollars • and eighteen cents'($2.18) in its cable programming service tier rate is unwarranted and excessive in relationship to the service provided and constitutes an unreasonable increase to • cable subscribers. BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: i ~ The Village Council of the Village of North Palm Beach, Florida, does hereby find and conclude that the proposed increase by Adelphia Cable Communications in its cable progamrning service tier rate by two dollars and eighteen cents ($2.18) is excessive in relationship to the service provided and constitutes an unwarranted and unreasonable increase to cable subscribers. i n 2. The Mayor and Village Clerk are hereby authorized and directed to • execute and file FCC Form 329, Cable Programming Services Rate Complaint Form, with the Federal Communications Commission on or before November 28, 1998. i 3.
