1996-045 School Concurrency/One-Cent Sales Tax• RESOLUTION NO. 45-96 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, SUPPORTING THE ADOPTION OF A ONE CENT SALES TAX AS A FUNDING SOURCE FOR PUBLIC SCHOOL CONSTRUCTION IN PALM BEACH COUNTY AND THE ADOPTION OF THE PUBLIC SCHOOL CONCURRENCY ORDINANCE. WHEREAS, Florida Statutes Section 163.3180 was amended to permit local governments to include schools as a concurrency requirement; and WHEREAS, Section 163.3180 requires prior to adopting • such a requirement, the local government should conduct studies to determine how the concurrency requirement is to be addressed and implemented by the local government, the School Board and any other parties responsible for school facilities; and WHEREAS, the Board of County Commissioners of Palm Beach County and the School Board of Palm Beach County formed a task force which studied the concurrency requirements and set forth a program and plan to adopt, implement and enforce the school concurrency requirement on a countywide basis; and WHEREAS, public schools of Palm Beach County are generally overcrowded and therefore not conducive to a good learning environment; and • WHEREAS, overcrowding in schools is detrimental to the entire county's development and prosperity; and • WHEREAS, school concurrency is the method of phasing residential development to the availability of schools to serve the development which will, as proposed, relieve the overcrowding within a period of several years; and WHEREAS, the Village of North Palm Beach, Florida, has determined that it is in the best interest of the Village that schools be included as a required concurrency service countywide; and WHEREAS, the Palm Beach County School Board is working on a five year capital facility plan to address the school plant planning needs of the entire county and that plan will require an adequate funding source. BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: • Section 1. The Village Council of North Palm Beach, Florida, supports a one cent sales tax as the funding source for the School Board's proposed capital improvement program. Section 2. The Village Council of North Palm Beach, Florida, supports the proposal for a countywide system of public school concurrency. Section 3. The Village Council of North Palm Beach, Florida, urges the Board of County Commissioners to place the Charter Amendment for School concurrency as well as a referendum choice to impose a one cent sales tax for school construction on the ballot for the voters to decide in November, • 1996, at the general election. 2 • Section 4. The Village Council of North Palm Beach, Florida, urges the Board of County Commissioners, the Palm Beach County School Board and the Palm Beach County Municipal League to work together to resolve their differences on school concurrency for the benefit of each and every Palm Beach County child. Section 5. The Village Council of North Palm Beach, Florida, hereby directs the Village Clerk to send copies of this Resolution to the Palm Beach County Board of Commissioners, the Palm Beach County Administrator, the Palm Beach County School Board, the Superintendent of the Palm Beach County School District, the Palm Beach County Municipal League and each municipality in Palm Beach County. • Section 6.
