A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AUTHORIZING AN EXTENSION OF TIME TO COMMENCE
DEVELOPMENT OF PROSPERITY HARBOR SOUTH, A PLANNED UNIT DEVELOPMENT
CREATED UNDER ORDINANCE NO. 32-91 OF THE VILLAGE UNTIL MAY 6TH, 1997;
PROVID]NG FOR THE REPEAL OF ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Village Council of the Village of North Palm Beach, Florida, enacted
Ordinance No. 32-9] which created a Planned Unit Development known as "Prosperity Harbor
South"; and,
WHEREAS, Section 9 of Ordinance No. 32-91 provides that the petitioner may obtain an
extension of one (1) additional year to commence development for good cause shown by enactment
of a subsequent Resolution without the necessity of advertisement or public hearing.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. The Village Council of the Village of North Palm Beach, Florida, finds that the
• petitioner has shown good cause for extension of one (I) additional year for commencement of
development. Development shall be commenced by May 6th, 1997.
Section 2. This Resolution is not intended nor should it be construed as modifying or
voiding the terms and provisions of Ordinance No. 32-91 and all such terms and provisions remain
in full force and effect.
Section 3. All Resolutions or pans of Resolutions in conflict herewith are hereby repealed.
Section 4. This Resolution shall take effect immediately upon its adoption.
