1996-002 Wabash Drive Water Lines AssessmentRESOLUTION NO. 2-96 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, APPROVING THE FINAL ASSESSMENT ROLL FOR CONSTRUCTION OF PUBLIC POTABLE WATER LINES ALONG WABASH DRIVE, CIRCLE AIRE SUBDIVISION, UNRECORDED PLAT, WITHIN THE VILLAGE OF NORTH PALM BEACH, WHICH FINAL ASSESSMENT ROLL IS ATTACHED AS EXHIBIT "A"; PROVIDING THAT SUCH ASSESSMENTS STAND CONFIRMED AND REMAIN LEGAL, VALID AND BINDING FIRST LIENS UPON THE PROPERTIES AGAINST WHICH SUCH ASSESSMENTS ARE MADE UNTIL PAID; PROVIDING FOR CREDIT TO EACH OF THE ASSESSMENTS OF THE DIFFERENCE IN THE ASSESSMENT AS ORIGINALLY MADE, APPROVED AND CONFIRMED AND THE PROPORTIONATE PART OF THE ACTUAL COST OF THE IMPROVEMENT TO BE PAID BY SPECIAL ASSESSMENTS; PROVIDING THAT ASSESSMENTS SHALL BE PAID AND COLLECTED IN THE MANNER SET FORTH IN RESOLUTION NO. 31-94 OF THE VILLAGE AND CHAPTER 170 OF THE FLORIDA STATUES; PROVIDING THAT THE ASSESSMENTS SHALL BE RECORDED BY THE VILLAGE CLERK IN A SPECIAL BOOK TO BE KNOWN AS THE "IMPROVEMENT LIEN BOOK"; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby approve the fin al assessment roll for construction of public potable water lines along Wabash Drive, Circle Aire Subdivision, unrecorded plat, within the Village of North Palm Beach, which final ass essment roll is attached as Exhibit "A" and made part hereof. Section 2. The assessments stand confirmed and shall remain legal, valid and binding first liens upon the properties against which such assessments are made until paid and the Village is authorized to collect the assessments in accordance with Resolution No. 31-94 of the Village and in accordance with Chapter 170 of the ' Florida Statutes. Section 3. The preliminary assessment roll reflected an estimated cost of construction of public potable water lines of $30,150.00 with an assessment for each of the eleven (11) properties of $2,740.91 each. The total cost has been determined by the Village Council to be $27,844.02 and each assessment is credited accordingly with the actual assessment as shown on the assessment roll to be $2,531.27 for each assessment. Section 4. The assessments shall be paid and collected by the Village in the manner set forth in Resolution 31-94 of the Village. Section 5. The assessments shall be recorded by the Village Clerk in a special book to be known as the "Improvement Lien Book" or "Improvement Lien Account" and the Village Treasurer shall thereafter maintain records and record assessment and provide accounting to the Village Clerk and otherwise operate in ' conjunction with the Village Clerk, as may be required by Chapter 170 of the Florida Statutes. Section 6. This Resolution shall take effect immediately upon its adoption. PASSED AND ADOPTED THIS 11TH DAY OF JANUARY 1996.
