A RESOLUTION OF THE VILLAGE COUNCIL
OF THE VILLAGE OF NORTH PALM BEACH,
FLORIDA, APPROVING MINOR
MODIFICATIONS TO THE PLANNED UNIT
DEVELOPMENT KNOWN AS "HARBOUR POINT
MARINA" WHICH WAS CREATED BY
ORDINANCE NO. 6-94 AND AMENDED BY
ORDINANCE NO. 23-94 WHICH APPROVED
THE DEVELOPMENT OF TWENTY-FOUR (24)
TOWNHOMES ON 3.420 ACRES DESIGNATED
AS PARCEL "D" AND KNOWN AS "MILLINGS
CAY"; THE MINOR MODIFICATIONS BEING
APPROVED ARE SET FORTH ON A DRAWING
ATTACHED AS EXHIBIT "A" AND MADE A
PART HEREOF; PROVIDING FOR THE
REPEAL OF ALL RESOLUTIONS OR PARTS
OF RESOLUTIONS IN CONFLICT HEREWITH;
AND, PROVIDING FOR AN .EFFECTIVE
DATE.
• WHEREAS, the Village Council of the Village of North Palm
Beach enacted Ordinance No. 6-94 which created a Planned Unit
Development known as "Harbour Point Marina" and amended such
Ordinance by Ordinance No. 23-94 which approved the development of
twenty-four (24) townhomes on the 3.420 acres designated as Parcel
"D" and known as "Millings Cay"; and
WHEREAS, Section 13 of Ordinance No. 6-94 provided that
modifications to the Planned Unit Development that are determined
to be minor by the Village Council may be approved by subsequent
resolution without the necessity of review by the Planning
Commission, advertisement or public hearing; and
WHEREAS, petitioner proposes modifications to Parcel "D" known
• as Millings Cay to allow construction of a wall/fence
• within the front set-back as shown on the on-ginal site plan on
Lots 13 and 17 of Parcel "D".
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FI~OR I DA
Section 1. The Village Council of the Village of North
Palm Beach, Florida, does hereby approve the modifications to
Parcel "D" (Millings Cay) of the Planned Unit Development known as
"Harbour Point Marina" consisting of the allowance of construction
of wall/fences within the front set-back as shown on the original
site plan, which modifications are more particularly set forth in
• Exhibit "A" attached to this Resolution and made part hereof.
Section 2. The Village Council does hereby determine that
the modifications to the Planned Unit Development are minor in
nature and do not necessitate review by the Planning Commission,
advertisement or public hearing.
Section 3. All Resolutions or parts of Resolutions or
parts of Resolutions in conflict herewith are hereby repealed.
Section 4. This Resolution shall take effect immediately
upon its adoption.
PASSED AND ADOPTED THIS 11th DAY OF April 1996.
