1993-032 Opposes Any Proposal for Juvenile Detention Facilities that Preempts Municipality's Authority' RESOLUTION NO. g9_g3
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PAJ.M
BEACH, FLORIDA, EXPRESSING ITS STRONG OPPOSITION TO ANY PROPOSAL
THAT PRE-EMPTS MUNICIPALITIES' ZONING AND PLANNING AUTHORITY OVER
JUVENILE DETENTION FACILITIES AND/OR ANY OTHER CORRECTIONAL
FACILITIES TO BE LOCATED WITHIN THE VILLAGE CORPORATE LIMITS;
URGING OTHER MUNICIPALITIES TO JOIN IN THIS OPPOSITION; PROVIDING
AN EFFECTIVE; AND FOR OTHER PURPOSES.
WHEREAS, it has come to the attention of the Village Council of North Palm
Beach, Florida, through the Florida League of Cities, Inc., that the Governor
of the State of Florida is considering a proposal which would pre-empt a
municipality's zoning and planning authority over the siting of juvenile detention
facilities and related correctional facilities; and
WHEREAS, the Village Council of the Village oP North Palm Beach believes
that this proposal would permit the placement of group homes for juvenile
delinquents in any residential neighborhood, regardless of the municipality's local
comprehensive plan and local zoning ordinances; and
WHEREAS, the Village of North Palm Beach has expended many staff hours
and many taxpayers' dollars in preparing a comprehensive plan in accordance
with Chapter 163, Florida Statutes, that has met with the approval of the
Department of Community Affairs and all other applicable agencies; and
WHEREAS, the Village Council of the Village of North Palm Beach desires
to protect all its citizens through its zoning process and desires to have input
into the decisions as to where different types of facilities are located within the
Village in accordance with good planning principles.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF NORTH PALM BEACH, FLORIDA, THAT:
' Section 1. The Village Council of the Village of North Palm Beach hereby
expresses its strong opposition to any proposals that attempt to pre-empt Village
' zoning and planning authority juvenile detention facilities and/or any other
correctional facility to be placed with the Village of North Pahn Beach.
Section 2. The Village Council of the Village of North Palm Beach hereby
requests all other municipalities to join, in this opposition and requests all other
local governments to contact their applicable State Senator and/or State
Representative to express this opposition.
Section 3. The Village Council of the Village of North Pahn Beach hereby
directs the Village Clerk to submit copies of this Resolution to each and every
municipality within Palm Beach County and to the Governor of the State of
Florida and all applicable State Senators and/or State Representatives.
Section 4. This Resolution shall take effect immediately upon adoption.
