1991-44 Prosperity Harbor North & South Special Referendum Election' RESOLUTION N0. 44-91
A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA, ESTABLISHING AND SETTING A BALLOT
FOR THE SPECIAL REFERENDUM ELECTION SET ON
JANUARY 6, 1992, CONCERNING WHETHER OR NOT ORDINANCE
N0. 29-91, WHICH CREATED A PLANNED UNIT DEVELOPMENT
KNOWN AS PROSPERITY HARBOR NORTH AND ORDINANCE N0.
32-91 WHICH CREATED A PLANNED UNIT DEVELOPMENT
KNOWN AS PROSPERITY HARBOR SOUTH, RESPECTIVELY,
SHOULD BE REPEALED; PROVIDING FOR AN EFFECTIVE DATE
HEREOF.
WHEREAS, Section 10 of Article III of the Charter of the
Village of North Palm Beach authorizes referendum proceedings;
and
WHEREAS, Section 10 of Article III of the Charter provides
that if a referendum petition is certified sufficient and the
Village Council fails to repeal the referred Ordinance within thirty
(30) days from the time the referendum petition .has been determined
sufficient, the referred ordinance shall be submitted to the
qualified electors of the Village; and
WHEREAS, the referendum petition for Ordinance No. 29-91
of the Village has been certified sufficient and the Village
Council has made a determination not to repeal same; and
WHEREAS, the referendum petition for Ordinance No. 32-91
of the Village has been certified sufficient and the Village
Council has made a determination not to repeal same; and
WHEREAS, the ballot for the special referendum election must
' be adopted and transmitted to the Supervisor of Elections of
Palm Beach County .
' BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA:
Section 1. The ballot for the special referendum election
set on January 6, 1992, concerning Ordinance No. 29-91 shall
read as follows:
"Should Ordinance No. 29-91 of the Village of
North Palm Beach which created a planned unit
development upon 33.42 acres, more or less,
located within the Village, and known as
Prosperity Harbor North be repealed?
YES
NO "
Section 2. The ballot for the special referendum election
set on January 6, 1992, concerning Ordinance No. 32-91 shall
read as follows:
"Should Ordinance No. 32-91 of the Village of
North Palm Beach which created a planned unit
development upon 63.48 acres, more or less,
located within the Village, and known as
Prosperity Harbor South be repealed?
YES
NO "
Section 3. A certified copy of this resolution shall be
forwarded to the Palm Beach County Supervisor of Elections.
Section_4. This Resolution shall take effect immediately
upon its adoption.
PASSED AND ADOPTED THIS 3RD DAY OF DECEMBER 1991.
