1990-34 Environmentally Sensitive LandABSOLUTION NO. 34-90
A RESOLUTION OF THS VILLAGE COUNCIL OF THB VILLAGE OF NORTH PALM
BEACH, FLORIDA, OPPOSING AN EFFORT SY THS PALM BEACH COUNTY BOARD
OF COUNTY COMMISSIONERS TO MAKE ALL COUNTY ORDINANCES RELATING TO
ENVIRONMENTALLY SENSITIVE LANDS APPLICABLE AND ENFORCEABLE WITHIN
MUNICIPAL BOUNDARIES.
' WHSRBAS, the Palm Beach County Board of County Commissioners
adopted Ordinance No. 89-23, the "Environmentally Sensitive Lands
ordinance," on October 17, 1989; and
WHSRBAS, said "Environmentally Sensitive Lands Ordinance"
contained a provision enabling municipalities to "opt out," causing
same to be inapplicable and unenforceable within their boundaries;
and
WHSRBAS, in recognition of the adequacy of the Village's
environmentally protective ordinances and regulations, and out of
concern regarding the intrusion of the County into the Village's
municipal home rule authority; and
WHEREAS, the Palm Beach County Board of Couttty Commissioners
on September 25, 1990, approved on first reading an Ordinance that
would place a referendum question on a ballot to be voted on
February 5, 1991, asking County voters to approve the applicability
and enforcement of all County ordinances relating to
environmentally sensitive lands within municipal boundaries.
NOW, THEREFORE, BS IT RESOLVED BY THS VILLAGE COUNCIL OF THE
VILLAGE OF NORTH PALM BEACH, FLORIDA, AS FOLLOW3:
' Section i. The Village Council of the Village of North
Palm Beach opposes the effort of the Palm Beach County BoarB of
County Commissioners to make all County ordinances relating to
environmentally sensitive lands applicable and enforceable within
municipal boundaries.
Section 2. The Village Council of the Village of North
Palm Beach hereby directs that the Village Clerk provide official
copies of this Resolution to each Palm Beach County Commissioner,
to the County Administrator, and to the Palm Beach County Municipal
League.
Section 3. This Resolution shall take effect immediately
upon its adoption.
