R2021-18 Opposing Development within Lake Worth LagoonRESOLUTION 2021-18 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, OPPOSING DREDGE, FILL AND CONSTRUCTION ACTIVITIES WITHIN THE LAKE WORTH LAGOON; PROVIDING FOR TRANSMITTAL; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Government Lot 1, LLC, of which current Florida Fish and Wildlife Conservation Commission ("FWC") Chair Rodney Barreto is a managing member, has sought to fill and dredge a nineteen (19) acre site the company owns in the Lake Worth Lagoon in order to construct hundreds of multi -family units, fifteen single-family homes and a marina; and WHEREAS, the subject property consists primarily of submerged lands west of Singer Island and located less than one-quarter (1/4) mile south of John D. MacArthur State Park and the Village's corporate limits (PCN: 56-43-42-15-00-001-0070) ("Property"); and WHEREAS, the Property is among the most pristine and ecologically abundant portions of the Lake Worth Lagoon, lined with mangroves and whose clear waters and sea grass serve as a nursery and migratory spot for manatees, endangered green sea turtles, smalltooth sawfish and other wildlife; and WHEREAS, in 2018, the South Florida Water Management District expressed serious concerns about potential impacts to the estuary resulting from development of the Property; and WHEREAS, the Village Council wishes to express its formal opposition to the development of the Property, as well as adjacent properties sold off by the State of Florida nearly one hundred (100) years ago, and determines that the adoption of this Resolution is in the best interests of the health, safety and welfare of the Village and its residents. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are hereby ratified and incorporated herein. Section 2. The Village Council for the Village of North Palm Beach expresses its opposition to the dredging, filling and development of the Property as well as adjacent properties west of Singer Island within the Lake Worth Lagoon. The Village urges preservation of this pristine estuary and the protection of the endangered species and other wildlife inhabiting the area. Section 3. The Village Council directs that a copy of this Resolution be transmitted to the Florida Fish and Wildlife Conservation Commission, the U.S. Army Corps of Engineers, the Trustees of the Internal Improvement Fund for the State of Florida and the South Florida Water Management District.
