2021-04 Code Amendment - The Shoppes at City Centre Commercial Planned Unit DevelopmentORDINANCE NO. 2021-04 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ORDINANCE NO. 2010-22 CREATING THE SHOPPES AT CITY CENTRE COMMERCIAL PLANNED UNIT DEVELOPMENT TO GRANT AN ADDITIONAL WAIVER FOR A MULTI -TENANT MONUMENT SIGN; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, through the adoption of Ordinance No. 2010-22 on December 9, 2010 ("PUD Ordinance"), the Village Council created the Shoppes at City Centre Commercial Planned Unit Development ("PUD") in accordance with the plans and specifications submitted by the Applicant, subject to the approved waivers to the Village's land development regulations and the conditions of approval imposed by the Village; and WHEREAS, Section 8 of the PUD Ordinance provides that any additional waivers to the Village's land development regulations shall be treated as a major amendment to the PUD; and WHEREAS, the Village Code only allows for a single multi -tenant monument sign, and the Property Owner, through its agent, is requesting a major amendment to the PUD to add a waiver for an additional multi -tenant monument sign in the location where a single tenant monument sign currently exists; and WHEREAS, the Planning Commission considered the waiver request at an advertised public hearing and recommended approval to the Village Council; and WHEREAS, the Village Council wishes to approve the additional waiver request and determines that the adoption of this Ordinance is in the best interests of the residents and citizens of the Village of North Palm Beach. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein. Section 2. The Village Council hereby amends Section 4 of the PUD Ordinance to grant the following additional modification or waiver from the requirements of the Village's land development regulations: I. Waiver from Section 6-115(B)(6) of the Village Code of Ordinances to allow an additional multi -tenant monument sign (Monument Sign 2 depicted on the approved Site Plan). Code allows for one ground sign depicting the name of the project and up to five tenants or occupants. Section 3. The additional multi -tenant monument sign shall be constructed in accordance with the plans prepared by Signarama dated September 23, 2020, which are incorporated herein by Page 1 of 2 reference. Prior to the commencement of work, the Property Owner shall obtain a sign permit for the scope of work approved in this Ordinance. Section 4. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a court of competent jurisdiction to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 5. All ordinances, resolutions or prior development permits or approvals relating to the Property in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other provisions not expressly modified shall remain in full force and effect. Section 6. This Ordinance shall take effect immediately upon adoption.
