RESOLUTION N0. 12-87 --1987 A RESOLUTION OF THE VILLAGE OOUNCIL OF NDRTH PALM BEACHr FIORIDAr PItOCIDURES ~ PROVIDE FOdt AND II~CO[TRAGE PUBLIC PARTICIPATION IN THE 1 PLANNING PROCESS TD UPDATE THE COtdPREHENSIVE PLAN PURSUANT Rl3 THE LDCAL OOVII2t~NP OOI4PREHENSIVE PLANNING AND LAND DEJEGOPMENT REQJIATIONS ACT AND CFiApTFdt 9JSr FIARIDA CODE. BE IT RESOLVID BY THE VILLAGE OOUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Village shall place an advertisement in a newspaper 1 of general circulation that puts the real property owners in North Palm Beach and the general public on notice that the Village has begun to update and prepare a proposed, revised Ccxnprehensive Plan in conformance with requirements of the 1985 Local Government Comprehensive Planning and Land Development Regulation Act, as amended, as well as an Evaluation and Appraisal Report of the Village's current Comprehensive Plan, and that copies of information, data and reports will be on file at Village Hallr the Library and the Public Services Building as they beocme available for public inspection and review. The advertisement shall be placed in a part of the newspaper other than the legal ads or classifieds sections of the paper. Section 2. At a minimum the Village shall use the monthly newsletter to provide a status of the comprehensive planning program and to keep the residents of North Palm Beach informed on the progress of the Comprehensive Plan and Evaluation of Appraisal Report. Section 3. in the initial advertisement that puts the residents and 1 general public on notice regarding the ocmprehensive planning pr+ogramr the public should also be notified that. written eamisnts from the public are encouraged and that written oamrsnts should be forwarded to the Village Manager's Office at 501 U. S. Highway #1r North PaLn Beach. FLr 33408. The public should also be notified that written oam~ent sheets will be available at Village Hall, the Library and the Public Services Building for the public's use. Section 4. At a minimum the Village shall hold appropriate public hearings as dictated by the 1985 Local Goverrxment Comprehensive Planning and Land Development Regulation Act, as amended. However, if'deamed necessary and appropriate by the Local Planning Agency that additional public hearings be held to discuss various elements or concerns related to the Comprehensive Plan and Evaluation and Appraisal Report, the same procedures and requirements of Chapter 163, Part II, Florida Statutes shall be adhered to. Section 5. The Village staff shall provide a written response to each written oarment sukmitted to the Local Planning Agency if the subject has been addressed by the Local Planning Agency. The response shall indicate the nature and the date of the action taken by the Local Planning Agency regarding the subject of the public ocmnents. If the Local Planning Agency has not addressed ' the subject of the written camYent, the Village staff will respond to the public oam~ent with the anticipated date of the Local Planning Agency discussion of the subject. Section 6. The Local Planning Agency shall, at a minimum, provide inforniation to the residents of North Palm Beach and the general public in a manner consistent with the public participation requiremP,nts stated above. Executive sucmiaries will be provided only when, and if, deemed appropriate and necessary by the Local Planning Agency. Section 7. This Resolution shall take effect immediately upon passage. PUBLIC PARTICIPATION PROCEDURES PURSUANT TO THE 1985 LOCAL GOVERNMENT COMPREHENSIVE PLANNING AND LAND DEVELOPMENT REGULATION ACT -.AS P,MENDED The Local Government Comprehensive Planning and Land Development Regulation Act (Chapter 163, Part II, Florida Statutes) and Chapter 9J5, Florida Administrative Code require that the local governing body and the local planning agency adopt procedures to provide for~~and encourage public participation in the, planning process. Therefore, the•V111age Planning Commission, as designated Local Planning Agency, recommends that the North Palm Beach Village Council adopt the following set of public participation procedures which shall be adhered to in up- dating the Comprehensive Plan pursuant to State Saw. 1.
