1983-36 Opposing Merging of MunicipalitiesRESOLUTT(~V N0. 36-83 A RESOLUTION OF THE VILiA(~ COUNCIL OF NORTH PALM BEACH, FLORIDA IN OPPOSITION TO THE AMENLMENT OF THE FIARILYI STATUTES OR THE ENACTMENT OF ANY SPE- CIAL ACT REiATIVE TO N~t.RGER OF MUNICIPALITIES 1 WHEREAS, Florida Statutes Section 165.041 (1982) currently provides that two or more mnicipalities may merge upon approval by a wte of the qualified esters in each area affected, and WLIEREAS, the Village Council of the Village of North Palm Beach deems the foregoing provisions to be of utmost importance to the pres- ervation of the rights of citizens of the various smaller mtnicipalities of t11is State and to the preservation of the very meaning of democracy itself, and WHEREAS, sore persons have suggested an amendment of the foregoing 1 pravlsions, or the enactment of a special act, to allow a merger of two or ~re mnicipalities through the device of a "wlsuier-take-all" referendum, and IdiEFtF.FvS, the Village Council of the Village of North Palm Beach is of the opinion that any such mrendment of the foregoing provisions, or the en- actment of any special act, would be detrimental to the citizens of those smaller mmicipalities, NUW, THEREFORE, BE IT RESOLVID BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FTARIDA: Section 1. That the Village Council of the Village of North Palm Beach, Florida, hereby expresses its opposition to any amendment of the Florida Statutes or the enactment of any special act, which would allow two municipalities to merge by any method other than approval by a wte of the qualified esters in each area affected. Section 2. That the Village Council of the Village of North Palm 1 Beach, Florida, hereby urges the Palm Beach County Legislative Delegation to oppose any amendment of the Florida Statutes or the enactment of any special act, which would allow two m.nicipalities to merge by any method other than approval by a wte of the qualified esters in each area affected. - z - Section 3. That copies of this Resolution shall be sent to each member of the Palm Beach Cotmty Legislative Delegation. Section 4. Zhis Resolution shall take effect itmiediately upon 1 passage.
