A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
- PALM BEACH, FLORIDA, DECLARING A LOCAL STATE OF EMERGENCY WITHIN
THE VILLAGE DUE TO THE COVID-19 PANDEMIC; PROVIDING FOR CONFLICTS;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Village Council is charged with safeguarding the life and property of the residents and
citizens of the Village of North Palm Beach; and
WHEREAS, Section 252.38(3)(a)5, Florida Statutes, grants the Village Council the authority and power
to request State assistance or invoke emergency -related mutual aid assistance by declaring a state of local
emergency in the event of an emergency affecting the Village; and
WHEREAS, Section 252.38(3)(a)5, Florida Statutes, further empowers the Village to waive certain
procedures and formalities pertaining to actions necessary to provide for the public health, safety and
welfare of the Village, as set forth therein; and
WHEREAS, the Village's declaration of a state of emergency is further governed by the provisions of
Chapter 8 of the Village Code of Ordinances, and this Resolution is intended to satisfy the requirements of
Section 8-5 and 8-22 of the Village Code of Ordinances; and
WHEREAS, a global Coronavirus (COVID-19) pandemic has placed the Village in a state of emergency,
exposing its citizens, residents and employees to danger to life and property, and the Village Council
determines that the adoption of this Resolution is in the best interests of the public health, safety and
welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA:
Section 1. The foregoing recitals are hereby ratified and incorporated herein.
Section 2. The Village Council hereby declares a local state of emergency within the corporate limits
of the Village effective Tuesday, March 17 at 10:30 a.m. Due to the statewide impacts of this emergency,
this declaration shall remain effective coextensive with the Governor's declaration of a state of emergency
as set forth in Executive Order Number 20-52, unless otherwise extended or rescinded by the Village
Council or the Governor. Village officials are empowered to take all actions necessary to ensure the
health, safety and welfare of the residents and citizens of the Village, as well as Village employees,
including, but not limited, the imposition of curfews, the closure of public buildings and facilities, and the
alteration of Village policies and operations.
Section 3. All resolutions or portions of resolutions in conflict with this Resolution are hereby
repealed to extent of such conflict.
Section 4. This Resolution shall take effect immediately upon adoption.
