1979-04 Requesting Permission of County Commissioners to Rezone LandRESOLUTION N0. 4-79 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NOR7'II PALM BF,AC}{, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS PURSUANT TO FLORIDA STATUTES 171.062 TO REZONE LAND TO BF. ANNEXED TO THE VILhAGE OF NORTH PALM BEACH FROM THE COUNTY ZONING ' CLASSIFICATION SINGLE FAMILY RESIDENCE AND COhIIV1ERCIAL TO THE VILLAGE'S ZONING CLASSIFICATION R-1 SINGLE FAMILY DWELLING DISTRICT. WHEREAS, the Village of North Palm Beach has received a request for annexation of the following described property: 1'he East one-half (E 1/2) of the Northeast one-quarter (NF. 1/4) of the Southwest one-quarter (SW 1/4) of t{te Northeast one-quarter (NE 1/4); and the West one-half (W 1/2) of the Northwest one- quarter (NW 1/4) of the Southeast one-quarter (SF, 1/4) of the Northeast one-quarter (NE 1/4); and the North 185 feet of the East three-quarter (E 3/4) of the North one half (N 1/2) of the Southeast one- quarter (SE 1/4) of the Northeast one-quarter (N F, 1/4) lying West of the North Palm Beach Waterway as shown on Plat of Golf Course Addition #2 (Plat Book 28, Page 67) ; ' all in Section 8, Township 42 South, Range 43 East, Palm Beach County, Florida. Subject to all easements, rights-of-way, reservations and restrictions of record. Legal description of a parcel of land in the area South of Garden Lane, East of Prosperity Farms Road, North of Prosperity Harbor, and West of the North Palm Beach Waterway; and WHEREAS, the Village Council believes that the proper zoning for t}~is parcel of land would be the Village zoning classification R-1 Single Family Dwelling District; and WHEREAS, Chapter 171.062 Florida Statutes suggest that when a mtanicipality desires to annex property at a zoning classification ' which would permit lower density than that which is currently in ei'fect under County regulations for the property in question, that the munici- pality request permission from the Board of County Commissioners f'or such a change which such changes to occur within two (2) years of annexation. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGF. COUNCIL OF NOR1'}{ pgLM BEACH, FLORIDA, as follows: Section 1. The Village Council of North Palm Beach, Florida, hereby requests the Board of County Commissioners of Palm Beach County, ' Florida, to consent that the Village rezone when annexed the property described above from Single Family Residence and Commercial Zoning to R1 Single Family llwelling District which will result in a decrease in the density allowed in the use of such land. Section 2. The Village Clerk is hereby directed to forward a certified copy of this Resolution to the members of the Board of County Commissioners, County Administrator and the County Director of Planning, Zoning and Building. The Clerk is further directed to for- ward a copy of the Zoning Regulations for Zoning District R1 of t}ie Village of North Palm Reach for the review of said parties. Section 3.
